    You need to phone the court first thing and stay on the line, and insist/remind them of your needs and what they agreed.

    You need to phone the court first thing and stay on the line, and insist/remind them of your needs and what they agreed.
    I will, but in the last few times i've phoned, the phone rings out, nobody picks up. Either that or a recorded message that they're busy and no facility to leave a message. Emails take 2 weeks to reply to.

    I've never been able to talk to anyone there.

    Hello everyone

    So I spoke briefly to the judge and she's adjorned the case as she says it can't be heard in an hour.

    The judge said she didn't agree with my argument of harassment and victimisation as the Claimant is just completing pre-action protocols.

    I really don't understand this point, can anyone enlighten me? Do you agree?

    It's up to the judge ... they don't always agree that the claimant has acted unreasonably in seeking to recover the "debt" prior to court action, and it's nothing unusual. Don't fret about it.

    You have to show a Judge that a line was crossed over and above the PAP. Did you read the PAP?  Do you know what a Claimant is allowed to do?  How did their conduct go unacceptably further?

    You need to show that they crossed a line that meets the high bar of harassment, and which means they were processing your data contrary to the DPA 2018 and the KADOE rules which only allow them to use DVLA data for one purpose.

    This was never going to be easy you know.  Counterclaims normally lose.

    You have to absolutely all over it, like @Eminowa and @Nosy were in the two unusual cases where they won their counterclaims by really pushing the evidence of distress and that the data should not have been processed further beyond the point where the PCN should have been cancelled.

    So if the judge is saying she doesn't agree at the outset with harassment I have to plug away and show her why?
