Court claim letter received

Hi All, I've read tons of threads and info & really need some guidance from the masters please!
I received a court claim form for a PCN that was issued in a poorly marked bay - outside a supermarket/retail park. No ticket on windscreen and the first I knew about it was a debt collectors letter. I appealed via the IAS and surprise surprise, it was rejected. I since learned about the conflict of interest with the directors at GS and am determined to fight this!!

I did request a SAR - from GS or the debt collector (can;t quite remember but am currently searching for paperwork) but didn't hear anything back. The next thing I received was LBCCC which I ignored and now the claim form. AOS has been filed.

Initially I felt confident appealing via the IAS as a case involving the exact same space in question appeal was accepted. The parking company also lied about the signage and stated that there were 2 more signs centrally (and directly in front of the space in question) which are not there.
To assist my appeal claim I returned to take photos and saw the PPC enforcement staff sitting in wait for people to park in this space and when the driver has entered the shop they run out take photos and run back to car to wait for the next! It's total entrapment!!

Since reading the blogs I intend to write to the supermarket again and request that they get involved. When i initially complained to the store manager i was told they had planned to do something about it but the bay remains as a PCN trap.

Do I re-submit a SAR to the solicitors? I've seen from other threads they ask for lots of personal information and ID etc when do they ask for this? They didn't when I applied before although this was on the phone.

Appreciate your help! I'm also considering using a company to do this for me if anyone can recommend? Thanks in advance AB

    What is the issue date of the claim?

    Which parking firm?
    Do I re-submit a SAR to the solicitors?
    No, the advice says email a SAR to the PPC themselves, using the contact shown in their data privacy page online. Not the solicitors.

    But do not then wait for the SAR results & photos, as you will have to do a defence anyway, as per the zillions posted here every month!

    Its UKCPM. Issue date of claim is 7 Nov 19 - so i have until 9/10 Dec I think but want to get it done asap.

    You are right with your target date.

    With a Claim Issue Date of 7th November, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 10th December 2019 to file your Defence.

    That's three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.


    When you are happy with the content, your Defence could be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. No need to do anything on MCOL, but do check it after a few days to see if the Claim is marked "defence received". If not, chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are trying to keep you under pressure. Just file it.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    Of course the IPC rejected you ..... it's Gladstones that set up the IPC scam ?????

    Did they add a fake amount of £60 in their claim ??

    so email the SAR to the DPO at UKCPM tonight , attaching a copy of the claim form and your V5C or a redacted but recent utility bill so they know its you for GDPR

    no point sending a SAR to GS or to any debt collectors, go for the jugular , the email is on their privacy page


    read the CEC16 thread about the CRA 2015 and abuse of process, plus the thread by beamerguy on abuse of process too , plus post #2 of the NEWBIES FAQ sticky thread

    Yes! Exactly. The amount they are claiming is:
    £172.53 (£100 for the PCN £60 Contractual Costs (is this the fake£60??) £12.53 Interest
    £50 (Legal representatives costs)
    £25 (Court Fee)

    I can't find the CRA 2015 post?

    Also was considering getting a company to do this for me? Thoughts?

    Search either for the Abuse of Process thread by beamerguy and you want the comment at post # 14 by Coupon-mad or search for user name CEC16, using Search this Forum, Advanced Search. Change the Radio Button from threads to posts.

    SAR Sent with claim form and DL ID. Do i need to notify GS too? I've seen this on another thread but i'm thinking that may only be applicable at earlier stage?

    [FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, it can cause the scammer extra costs and work.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
