Why bother? You'll never be able to agree a suitable compromise.AB0013 said:In counter claim - I meant re Le Kirks suggestion of Couter offer in reply to their 'Without Prejudice' offering a reduction in costs
You don't want to pay anything. They want a lot more than that.2 -
So I have received the witness statement via email along with this statement below:
"The assumption is that our Client is not attending the hearing and therefore we kindly request this notice be treated as a notice pursuant to CPR 27.9. However on some occasions our Client may wish to attend and will do so.
We confirm the statement has been filed at the Court."

Don't already have a hearing date?
It's 'usually' two weeks after witness statement and evidence is due to be filed and served, but can be different.
Also, we are not in 'usual' times.

As KeithP says you should already have a hearing date, check your papers, unless you are one of those where courts have been sending out deadlines for witness statements ahead of dates for hearings. Search the forum for Jack Chapman signature. If you still have time before needing to submit your WS, it might be worth adding to your case.1

Its weird for you NOT to have a hearing date
However
Even if you have one, good chance it will NOT go ahead. You have to stay ontop of htis.1 -
No hearing date yet - court is temporarily closed, but managed to speak to another department who checked. Will submit my WS via email and hand deliver in hope I can post through door. Thanks for your help everyone! Will upload WS too.0

Take a photo (or better still a video) of you posting it through the letter box not the door!1
