The database wasn't extant in 1988.
The policy being recorded on the database is evidence of insurance under the act.
Emails on a phone, even paper, are not always evidence of insurance - simply because they're so easy to forge or to retain after cancellation.

If they were always taken at face value, it would be trivially easy for any uninsured driver to "prove" they were insured, and there would never be any uninsured cars impounded.

Edit: S165RTA88 was actually added by the Serious Organised Crime and Police Act 2005.
    http://www.legislation.gov.uk/ukpga/2005/15/section/152

The database wasn't extant then, either. So it's all down to what is considered "evidence", and that's down to legal precedent.
Sure documents can be falsified, and I guess it's up to the officer to decide whether they're evidence.

But the point remains that under the Act the police only have the power to seize if the driver fails to produce such evidence. He says he wasn't given such an opportunity.

Doesn't matter. It's down to when the plates are manufactured.
According to the DfT's guidance "the space between the age identifier and the random letters must be 33mm"

There are no random letters on the old-style plates.

I'm reading that as the change was done online on Tuesday 12th lunchtime, and the OP was pulled over at 11pm on Wednesday 13th. The V5C has come through in the post since then, showing an issue date of 12th.

IIRC the ANPR systems in police cars are downloaded locally and searched off-line, while DVLA batch-process changes overnight.

I dont know whether the area cars are fitted with ANPR, however it doesn't matter as a live time check would be performed once the car was stopped.

the officer said to me about documents being able to be falsified and that because of the time they were only able to go by the police computer database. she told me i’d get my car back because she actually believed me so she said it will be fine. she told me a letter was coming home but didn’t mention points and a fine. i’m new to this i’ve never been pulled over before. but the officers at the police station saw all my documents and even though the car wasn’t on the database even then, they still gave my car to me.

admiral gave me a letter saying time stamps and they said that they made the amendments to the policy, provided correct documentation and issued the details of amendment to MID and cannot agree they have made an error in the administration of my policy. “we do understand it can take 7 days for MID to update however we have no control over this process”

Nor do the police but somehow you think its their fault that the insurance industry operate in this way.

You do realise, i was insured otherwise i wouldn’t be here? I have a written legal document from my insurer with time stamps of events and everything that they did to show they didn’t actually make a mistake and my logbook to show that neither did DVLA?

Road Traffic Act 1988 you seize a vehicle if the member cannot show documentation he is insured. I wasn’t allowed to because they said my documents didn’t matter

My documents didn’t matter when i was at the police station the following day trying to retrieve the vehicle

With these things there is always more to the story than meets the eye, when I swapped my plates there was a time window for changeover (that was in the days of tax discs) .

I don't believe the Officer and sergeant just went ahead and produced the charges.
They have to operate within the law and rules too.
Perhaps you went ahead with the changeover too early by a day?

12/10/19 - same date as my logbook

    Dear Mr Asim Tahraf

This is a courtesy email to inform you that we have received confirmation from the DVLA that your transfer has now been approved.

You will receive your new updated V5C Log book direct to the registered keepers address normally in 3-10 working days, but you should now legally display your new registration once you contact your insurance company to advise them of the change. The DVLA details for your vehicle (MOT and Tax) will update within 2 working days here.

If ordered, your number plates have already been despatched to you. If you haven't you will need to wait for the new log book to arrive in order to use as proof of entitlement to get your new plates made.

If there’s a delay for the police database then the law should take it into account. Not throw around seizures. The police officer will have to take a day off work and show up at court now :(:(
