as above , google BARRY BEAVIS , who went to 3 courts , the last one being the Supreme Court, but he was on a retail park with a 2 hour free parking option, he wasnt on airport land or airport roads where bylaws apply (no bylaws applied in his case and he was parked up , on a car park , not stopping on an airport road)

POFA applied in his case , it doesnt in yours ,so as different as chalk and cheese

google him, find out the background story , he was on tv , in the papers, only the man on the moon wont know about him !! lol

I have read various threads on this site but i find it all quite confusing at times , some of the information just ends up confusing me more.
I was under the impression that I should just keep ignoring all the letters as this would never be taken as far as court but now I'm worried that VCS might actually take this case all the way.
I am prepared to fight it though as I am angry that despite telling them that my granddaughter had been sick in the back of the car ( who incidentally had a cleft palate at the time , since had her operation to fix it and could of choked they still never gave my appeal any thought )
If anyone needs any electrical work doing I could do that in my sleep but understanding anything to do with our legal system really scares me that I might end up getting myself in more trouble than I had bargained for .
I will have another read through some other cases and try harder to get my head around it .

    Thanks

nobody said it was simple and its confusing for everyone , law matters are like that , especially at airports , ports and railway stations, due to being controlled using bylaws

the parking companies exacerbate this by mixing up the issues , it suits them to do so, dont feel bad about it, its the way it is and nobody said it was simple , because its not simple

you should always assume that a pcn could end up in a court , the nature of the court may be different , be it magistrates court or civil court , but court nevertheless, so always work on the basis that it will end up in a court, then you are prepared for it

there are many legally trained people and solicitors that do not understand these issues, so how can you ? that is why its down to a judge or a magistrate to decide

read the UKPPO thread posted by Bountyhunter , every possibility happned to various people (over 20) in that thread , except nobody was taken to magistrates court, but around 25 cases were mentioned in that one thread alone (Newcastle Airport)

you may not understand it, but its clear that nearly every one was won by the defendant, but the reason you are ignoring letters is in order for it to either time out after 6 years , or for a court case to be issued, so that you get clarity and the issues cease when they discontinue or they go to court and a judge decides as happened in those cases at Newcastle

What they don't tell you is Beavis helps your case. Their Lordships declared that add on amounts to the ticket couldn't be added. I bet they've added on extras to your ticket such as debt collectors fees haven't they?

Parking companies lie. When they aren't lying it's half truths.

If you can have somebody sit down with you and go through the relevant sections (only) of the NEWBIE sticky post #2 and explain it, that might help. It might surprise you to learn that of the regulars posting on this forum only a very few (maybe 2-3) are legally trained, the rest have a variety of jobs and experience (including electricians) and some are retired (or cured, as I like to think of it) and post their advice by having read about it, experienced it from the victim side or by applying general knowledge and common sense.

Yes , they are adding more money on with each letter that comes and threatening more costs on top such as court costs , solicitors costs and interest too

Yet the Supreme Court said that's a no no. Costs are already incorporated in the fee. I wonder why they don't mention that in their [STRIKE]pack of lies[/STRIKE] letter?

    Hi Le Kirk
I can tell from some of the replies that the people giving me information are very educated people and I really appreciate their help. I have seen the same names appearing on the other threads I have read so I can tell they really know their stuff on these cases which is why I'm holding out and not paying . I noticed in one case they had been giving they guy advice for months and then despite the advice they had gave him he folded and ended up paying the cowboys.
I am determined to try and fight this even if its just out of principle.

Like I said, it worried and surprised me that you had no idea, and you have just confirmed it. But at least you can read threads and learn now, in time!
but now I'm worried that VCS might actually take this case all the way.
They will. Simply search the forum for:

ANOTHER VCS ONE BITES THE DUST (to see how these cases progress and are won)

    and

VCS Airport (to find the shedloads of other threads exactly like this one)

You are missing the entire point of the forum if you don't know how to search and find the info you really needed. Don't stay on your thread only!

We've seen dozens upon dozens of threads over several years about LJLA/VCS stopping cases, yet have (as far as I know) only see one court case, which ended with the defendant settling before a judgment was reached.

Since then, VCS have become more and more litigious in general parking cases, but are still not pursuing LJLA cases. You have to question in your mind, why?

Do not confuse any court cases reported in threads about VCS stopping cases at the very-nearby Liverpool Business Park - a rather different scenario.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
