Hi All
Really need some helpful advice if possible regarding a Pcn my wife got for picking me up from John Lennon Airport in September. Basically I had been working away in France and flew home to see the family for a few days , have used the airport loads of times and always go into the pick up car park , pay the couple of pound and go home happy but on this occasion my wife was coming to collect me and had our 7 month old Granddaughter in the back of the car who kindly decided to vomit every where on the journey up . Wife rang me saying she wasn't going into the car park as she wanted to get back to sort the mess out so I walked up the approach road and she literally pulled over and I jumped in . Photos on the Pcn ticket show a difference of 1 second on them that's how quick it was.
Received the Ticket a few weeks later so looked up similar cases on here and sent off the appeal letter I found on this forum. I have since received a reply saying they can see I wasn't the driver and that they want me to send the drivers details to them so they can pursue her instead . Obviously I'm not going to give her details but really don't know what to do now , I wouldn't of minded if it was £20 or something but £60 for a 1 second stop is ridiculous .
Any help would be gratefully received .

I have read a few cases and found one that is so similar to mine but not being very clued up on this sort of thing i find some of it mind boggling. People are saying don't tell them who the driver was but unfortunately when i went on the company site to do the appeal it asked for a reason i was appealing and i put in the little box about the granddaughter being sick and mentioned that it was my wife driving ( although i didn't mention her name ) so im unsure if they can pursue her now that they know that. foolish of me to put that i know but at the time i was just being honest ( more fool me ). Just need to know if i reply to their letter asking who the driver was or do i just reply saying sorry i don't have the information they need.

Could be very useful to you should this get to court, that they are chasing the wrong person as they failed to respond to your (part) information about who the actual driver was.
But we're a long way from there at the moment.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Having appealed all you can do now is wait and see if they issue court papers.
You will be bombarded with debt collectors letters before that happens. Please don't panic about those.0 -
If you've told them that they should be back to you like a flash asking for the name and address for service of the driver. Proves that they don't read appeals, they only reject them.
Could be very useful to you should this get to court, that they are chasing the wrong person as they failed to respond to your (part) information about who the actual driver was.

I have posted the reply letter that they sent me below , they have acknowledged that I wasn't the driver and asked me to provide details of who was driving which is where I'm kicking myself for being honest in the original appeal I sent . I am just wondering do I reply saying I don't have the drivers details or do I just say my wife and I are no longer together and I have no forwarding address for her ?

We refer to correspondence received from you concerning the above numbered Charge Notice.
Please note that responsibility for this Charge lies with the driver of the vehicle at the time the contravention was
observed. However, it appears from what you have stated in your appeal that you were not the driver on the date in
question.
In order for us to process your appeal correctly, please follow the instructions below:
1. Notify the driver of the vehicle that they will need to appeal to us directly, including their FULL NAME (Forename
and Surname) and a valid FULL SERVICEABLE ADDRESS within 14 days.
2. If you are representing the driver we require a signed and dated statement from the driver of the vehicle confirming
that you are authorised to appeal on his/her behalf; this needs to be an original signature and not a photocopy or a
stamp. The statement MUST contain the drivers FULL NAME (Forename and Surname) and a valid FULL
SERVICEABLE ADDRESS.
Please ensure that correspondence is submitted through the portal blah blah blah in order to correctly
adhere with the appeals process.
OR
3. Pay the PCN. Payments can be made online at blah blah blah by following the links for "Pay Now",
or over the phone by calling 0845 226 9138 and using a valid Credit or Debit Card to make payment. It is your
responsibility to ensure that payment is received within our office by the date specified.
As a gesture of goodwill we have placed the charge on hold for an additional period of 14 Days to enable one of the
above actions to be complied with.
We are willing to re-offer you the original discounted charge of £60 as full and final settlement of this Notice, if
payment is received within our office on or before the 01/11/2019.
If payment is not received by this date, the amount payable will revert to £100. Failure to pay this charge within the
stated times, may result in Debt Recovery Action being taken and further costs up to an additional £60 being incurred.

If you don't want to do this , then ignore
POFA doesn't apply on airport land so as Keeper and not Driver you have no liability and can say no comment , or ignore which is what most of the regulars here would do0 -

Been with her for 28 years so she must be ok i suppose , it would only be me that pays her fine anyway because as she keeps reminding me she was only there because she had to pick me upI would ignore that letter.

I always try and be as honest as possible as its hard to remember things you say if your lying. Cant remember what i did last week most of the time so i'll stick to actual events so i don't dig myself any bigger holes .0 -
We know all about the no stopping scam , even on red routes , but nothing you can say or do will make this go away
In theory the airport should take the driver to Magistrates Court , within 6 months , same as if she was speeding for example , a loss there may incur costs , penalties etc
If the charges are contractual , then VCS could try taking you to Civil Court and let a judge decide the outcome , a loss there could be up to £200 for example
Yes it's complicated which is exactly how they like it , mind bogglingly complicated
A win in court means neither you or your wife pay a penny
Sometimes saying no comment or I cannot remember is better than blind honesty
