    The words about costs are not a defence - they are merely damage limitation to reduce the costs if someone loses - so of course she needs her first paragraphs about other defence issues to remain, just to be clear.

    my mums got couple of question's was wondering if anyone can answer,
    has cel paid the court fee or have they not yet?
    what are the chances of cel dropping the case or for the judge to throw it out?

    There is a filing fee, that they have paid (£25) and later there will be a hearing fee of another £25 later, if they do not discontinue, which they sometimes do, but much later than this.

    what are the chances of cel dropping the case or for the judge to throw it out?
    As above, CEL sometimes discontinue just before a hearing, and they sometimes send a letter trying to persuade the D to settle. Don't settle.

    Judges do not usually strike a case out before a hearing but we almost always see wins at hearings, and there is no risk and it's not very scary, more like a job interview, something to be psyched up for and smartly dressed, that's all.


    The defence looks fine but this sub-heading needs bolding and separating from the para above it:

    Re the defence, all paragraphs need a number. Re court fees, the filing fee must have been paid otherwise you would not have got this far and I believe hearing fees will be due once DQ has been issued and returned and court has been allocated. When the court is allocated a letter is sent out and that includes deadlines for filing and serving witness statements and paying fees (claimant).

    lol if it was on my name I would have been very psyched up but its in my mums name and her English is not very great, hence why I was saying I was going to go and defend it for her but luckily I asked and told that is not possible as its on her name and she needs to be there so will have to go with her as her lay representative or McKenzie friend.

    do you mean number the letters and 15.1 etc aswell

    okay will add that title instead of link but the reason I didn't para number between 21 and 22 is because those quotes are from the website aren't they?
    so shall I add title and add para numbers to those quotes between 21 and 22
