    2.The defendant not being the driver, does not believe that the claimant has complied with the strict keeper liability procedures within The Protection of Freedoms Act 2012 Schedule 4 ('the POFA').


    In addition to a lack of liability due to liability not properly being passed from the driver to the keeper, as set out in the POFA, I deny I am liable for the entirety of the claim on the following grounds:

    When filing the Defence, please do not use MCOL, but instead follow the guidance offered in post #5 above.

    yes sorry that's what I meant send it through to the email.
    I have now edited to show coupon-mads text to the defence, will hopefully scan it tomorrow to send to the email.
    so what happens after they have received it and how long does it take for a hearing date.

    Look around. Read other threads.

    Earlier today a poster reported getting a hearing date in February 2020, but of course it is going to depend on how busy the particular court is.

  • hi, so its nearly going to be a next week, since my mother sent her defence she has not received no letters back from CCBC or Parking eye except from a letter from CCBC that they have received mums defence. so was wondering if anyone can advise my mum on what to do next should she print the DQ and just send it or carry on waiting.

  • My mother has finally received the DQ, i was woundering as i am going to be her lay representative, i am kinda stuck on d4 i kinda booked holidays for 2 months i booked them before she got the county claim so can i write the dates i won't be here as lay representative and witness.
    My mother has also not recieved the SAR from CEL yet either so shall she send it again?
