    She could always put in dates when you will both "not be available", she doesn't have to say it is your availability. When was the SAR submitted? They have 30 days to respond. If it outside of the 30 days then (your Mother should) complain to the ICO.

    Right so where it says dates not available then it says :
    Yourself just type in mums not available date

    She don't need to write in the other 2?
    Won't they ask for proof as to why i won't be able to make it for 2 months.
    Its been more then a month now, so how can i complain to ICO.

    That is correct. As far as I know (and I've never received a DQ, although I've asked Auntie Google what they look like) it doesn't ask for proof. It could be pre-planned holiday, business trip etc.
  • Lol thanks, one last question it says to serve copies to all parties, will the court do that once she send the DQ to the court or does my mum have to send it herself to CEl

    The DQ has to be sent to (served) on the claimant by you (your Mum).

    Couple of more questions bout the DQ many thanks for the replies.
    On d1 hearing venue, the town my mother is living has only a crown court and magistrates court the nearest county court is like 30 mins away in a different town so shall i use the crown court or the county court that is 30 mins away i never been to court so have no clue what the difference are

    On d3 witnesses shall i put 2 or 1 as i am going to be there as her lay representative and like a witness i can vaguely remember the 1st letter she got from the pcn that on the photo of the car leaving u can see a male figure in the driving seat but can't remember properly now as its been a year. That's why i was hoping to get a SAR but after a month have not recieved anything

    check if the nearest court does civil claims , usually its the county court , not crown court, but in large cities they can be located in one building or near each other, I think crown is for criminal matters, plus there are magistrates courts too

    so try to choose your local county court for civil court claims and civil matters (not criminal matters) , plus NOT magistrates court

    put down the largest number you think MAY attend , so say 2 or 3 or whatever, its only so they allocate a room large enough, so a handful of people is neither here nor there, but if 30 were attending it would be different. doesnt matter if you put 4 and only 2 turn up

    send another SAR with proof of ID as a reminder and give them 7 days, email to their DPO

    Stick your postcode into CourtFinder. You are looking for the nearest County Court.

    Put only 1 (mother herself and of course she signs everything, not you!). I say, DO NOT volunteer yourself as a witness! Just be her lay rep, which needs no prior permission.
    i kinda booked holidays for 2 months
    Put the entire two months off, as if SHE is unavailable and just put 'holiday - pre-booked' as the reason.

    And obviously add a week either side to give breathing & prep space, you don't want a hearing 48 hrs after flying home.
