No nothing is in my name i either wrote driver or defendant i only sent them the appointment letter nothing else but they didn't accept it.

bear in mind you said MY DEFENCE , its not yours , its your MOTHERS DEFENCE

No, not the appeal earlier on. We don't care about that.

We are asking - did you do the AOS in MUM'S name, as she must defend it if she is the named Defendant?

Yes its done in my mums name but the plan was if it does go to court i was gna go in her behalf, is that possible or does she have to be there aswell?

You can go as a McKenzie friend but are limited to whispering in the defendant's ear and passing documents.

Alternatively you can go as her lay representative and act on her behalf, but she must attend and answer questions if asked.

Take a copy of the lay reps right of audience with you to give to the judge on the day if required. You do not need to tell the court in advance.

Search for beamerguy's "abuse of process" thread. It is never far away so a quick scroll down should find it, or use the seach this forum facility, setting the criteria to "show posts".

if it goes to a hearing she MUST attend , its her name on the paperwork

you cannot GO on her behalf , you can attend and help her as a lay representative or as a McKenzie friend (look them up) , but you cannot just turn up on her behalf whilst she stays at home or goes out shopping

its HER name on the court order , she must be there to defend herself and answer questions etc

this was why I stated that its all in her name and you must not use the words "ME , MYSELF & I" , they do not apply here

we are having to see through what you say to understand what she is actually doing , so its important that you know that you are merely a helper, like the rest of us here , nothing more , just an advisor , guide , friend , helping her in her hour of need

as for those Judges names, if you had read other recent threads on here plus the abuse of process thread by beamerguy , (or used the forum search box and put GIDDINS into it) you would have found other threads with the info, including already written defences containing the paragraphs you need to help your mum add them to HER defence
