    As well as this,
    Under the Equality Act 2010, the driver has 'Protected Characteristics' which extends to them the unequivocal right to use any 'reasonable adjustment' provided by any landholder/client/operator when visiting a customer-facing environment, including car parks.!
    In short, the Act says that protected people and their carers can legally use any disability provision applicable to them, and in the case of a disabled bay this would be with or without a Blue Badge (the Act has nothing to say about permits and badges because the legal right is established by need).!
    Any term that UKPC may have on their signs to the effect 'Blue Badges only' is null and void if the effect is to deny a disabled person the statutory right to use a reasonable adjustment without penalty.!

    So send these 2 separately in a file with the defence ,ideally she want to send her defence by tommorow as she has only got till friday so if theres anything she missed please let me know.
    Also does mom have to send the claimant it, as when she sent her last defence the court said that they will be posting it to them as well when she already did, might save her a bit of time if she don't.

    Does she also need to send a summary costs assessment with the defence.
    Mom was thinking about £70 for print, post and time wasting do you that's a okay amount to ask for or should she have it a bit higher.

    Cost schedule goes along with the Witness Statement and evidence.

    Those 3 items above , WS plus Exhibits plus costs schedule go into 3 bundles , one to the court , one to the claimant and one to be taken by the defendant to the court on the day

    You cannot ambush them on the day , full disclosure from both sides beforehand

    Okay so after she has sent the defence the court will set a date and i need to hand them in 14 days before the court date I'm assuming

    Correct! Swansea County Court seems to require witness statements 2 months in advance!

    i am getting a bit confused, what do i have to send on Friday which is when the deadline is, the court said that i can amend my defence so i thought that's all i have to do at the mo, i will be away for 2 months starting Sunday which i have wrote on DQ so they cant set a date till im back or can they

    As I read your thread it is my understanding that you need to submit an amended defence by Friday. This whole business of WS and evidence started because you asked about a summary cost assessment. You were told no, that goes with WS and evidence and posters gave you helpful advice about what to do WHEN the time comes to submit WS and evidence. For now just comply with the court's directions.

    Hi hope your all well,
    So my mum has recieved these letters,

    So just to make sure after the date of the 1st letter passes and if they haven't paid the fee will the case get dropped and how long will it take for them to tell my mum if they paid or not as less then a month after she will have the hearing and shall i start on my WS now or wait till after that date?
    One more thing is she sent the ammended defence to the same email she sent her orginal defence but unlike her orginal she did not receive back confirming if they have received it just a automated email so shall she ring the court to ask if they have recieved it?
