They have been known to be backed up but that is a long time. Presumably you kept proof of sending. Might be worth a call to check but it is often posted that calls to CCBC go unanswered for long periods.
  • Or just take a photo of the DQ and email to them. Easier, and certain.
  • Thanks for the replies after my latest panic - I understand all of you regulars must see a lot of flapping posters like myself who are in unknown territory with these people!

They must have just had an xmas backlog as all has now been received and updated - the case has been transferred to my local court so I guess I just wait now and see what happens from here!

Well yes, you can have a few days off, but then you need to prepare yourself for the next episode.

Keep reading post #2 of the NEWBIES thread. :D

Well, I was really hoping that it wouldn't come to this but it was inevitable I suppose.  I've now got my court date for the first week in April.  Is it too late for a SAR request to CEL? I'm hoping that their photo of the car may show that I wasn't driving - not that I'm entirely sure that, that would help.

Awkwardly, the court that it has been assigned to, I've now moved from - I'm now a 5 hour drive from the court.  Are they likely to reallocate based on the fact that I have a child in school, a 2 year old and my husband works (I have no childcare here)?

I'm off to read post #2 some more...
  • My mum sent me over a copy of the court date paperwork and it states "preliminary hearing" and requests no further information (just my attendance in April) - it states no witnesses are required etc and encourages speaking to the claimant to resolve ahead of the date.  From what I've read CEL are unlikely to close it off but i'll continue reading post 2 to see if there is anything referencing preliminary hearings.

Explain to the court an ask them to allocate to your nearest court

You could try submitting a replacement DQ to ask the court to move it.  Also you SHOULD send an e-mail to the court and the DPO of the PPC informing them of your new address for service and requiring them to erase your old data.

Hi all, in all of the worlds madness at the moment it was easy to put this to the back of my mind however I need to get it all out of my hair now as I hate the looming stress of it all.  Well, the court accepted my change of address fine however in the midst of the Coronavirus pandemic have chosen to carry out a 'preliminary hearing' via telephone (sucks as, as i'd imagine most do I was hoping for non-attendance).

They advised to settle out of court which then prompted a call from CEL saying that they'd reduce costs to £85.00 - PCN + £25 admin fee.  I felt stupid for not taking this as I know it would have been an end to it all BUT...you guys have helped me this far, I felt it'd be a shame to give up now.

Any advice on what this telephone preliminary hearing will consist of? I just want to make sure that I'm armed with everything possible...heading back over to the newbie thread now but I couldn't see anything on preliminarys.

the newbies thread wont help with covid19 changes

it is what it says , a tele conference call where you and the claimant and a judge are on the phone call or similar , like you see on tv at the moment with people at home talking to people in a studio

as long as all the paperwork is in and you are happy to do it , then its your choice, or wait months for a face to face confrontation

there was one reported on here the other day , did you read it ?

they could not get hold of the claimant so the judge found for the defendant
