    Quick question, as a defendant am I able to see if the claimant has filed their AOS, DQ etc on MCOL? I've filed mine along with my defence and it is all showing on MCOL.

    Would just be useful to know if they are doing anything as I haven't received a copy of the DQ from VCS yet (I sent them a copy of mine) and they've ignored my subject access request for over a month now so I've reported them for a breach of the data projection act.

    So as an update I’ve now been allocated a court date on the 3rd of March in Gloucester with District Judge Singleton. The letter states they have until February the 4th to pay the £55 fee or file a properly completed application, is this normal?

    I got a letter from VCS today stating they believe they have a strong case but are willing to settle out of court for £125, I’ve rejected this out of hand.

    Going to start gathering my evidence now as the court want that by the 24th of January.

    Quite looking forward to it to be honest, moneys not an issue it’s a point of principle.
    I think I’ve got a strong case on top of what you usually recommend on here:
    - Signs that don’t state the correct name of the car park or match the main entrance sign.
    - There are areas of the car park that VCS don’t have jurisdiction over as shown on their own map they sent to me (that’s ANPR gone as evidence for them)
    - Correspondence from them referencing the name of a car park on the other side of Gloucester that they don’t cover. They’ve called the car park 4 different names so far...

    Perfectly normal. Nothing unusual there.

  • So just received the evidence and witness statement from VCS written by some paralegal called Yousra Ibrahim.

    Had a quick scan through and a couple of immediate take aways:

    1. The majority of the witness statement is clearly a copy/paste job as it quotes items on the signage that don’t exist so I will pull that apart.
    2. Only contains photo evidence of signage for half the car park with the photos 2 years old. The other half where signage is sparse they conveniently left out photos of this area.
    3. Some of the retail park has been redevelopment since the photos were taken so current signage doesn’t match.
    4. Most amusing of all they state in the witness statement that the location can be called any name they want on the sign. Considering they quote the sign as being the contract it’s quite fundamental that you are aware of the location the signs represent so the name at the top is pretty important.
    5. The 2 claims are combined but they are still claiming £185 for each so I will be all over the abuse of process element.

    I’ll get on with doing my evidence and witness statement now.
  • Quick question, I've just been getting on with my Witness statement and evidence and largely done. However today I've received a separate pile of paper from VCS titled 'reply to defence' from a different paralegal to the one that did the witness statement.
    I've done a quick search and can't find much information on the 'reply to defence' so is this normal to get this after the witness statement and does it need to be referred to in my witness statement?

    Thank you. Thought as much so will have a read through and reference/pull it apart where necessary. Strange thing is that their witness statement responds to my defence so hopefully as this 'reply to defence' is done by a different paralegal they will contradict each other.
