I's only because this has been questioned so many times over the years, we get a little jaded.

Here's one asking the exact same & a link to what happened in a Mediation call, as a cautionary tale:
    https://forums.moneysavingexpert.com/discussion/5470919/excel-parking-bw-legal-court-paper/p4

The point is, it's the Mediator who will bully you into settling...and you will learn NOTHING about the claim.

It does actually. Would you be content that valuable and scarce regular resource was unable to help you because (for anyone and everyone) we were deflected through chewing the cud over all the advice we give based on the work we've put into this stuff over years and years? It's rather a slight on our ability to deal effectively with the complexities of all this - for your benefit.

Do you go around the houses questioning everything that your Doctor, Dentist, Surgeon, Solicitor, Butcher or Milkman advises?  I really hope not too.

If everyone debated the insides of the elephant's backside with us on any point they choose, the forum would simply crash.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I have been coming here 7 years and seen this question and answers many , many times before, In fact I see very little new on here due to the fact it tends to be like the novel Dreamcatcher , namely S S D D , which usually means a lack of research on the topic , like asking why the same species of birds on different Galapagos islands are slightly different , totally ignoring the research Darwen did

There really is no need to question a pilot how a 747 manages to fly nor why the wings dont just drop off every time you go on holiday abroad , just accept that all the pilots doing the job cannot be wrong and you dont need to know and its not their job to explain it to everyone that asks

having just re read the link coupon mad posted and seen it and participated in it some 4 or more years ago made me realise just how that thread is so relevant given that the OP in it went through both scenarios , mediation (useless) and court (successful) and it was a pleasure to see the stark difference between the two options and why the mediators dont look very good or impartial when it comes to parking disputes over money

Does it really hurt if someone occasionally gently challenges the orthodoxy, ...

When people ask the same question time and time again, when, if they had bothered to read and understand the sticlies/newbies, yes it hurts.

I submitted my Directions Questionnaire as a PDF by email on 20/04.  Deadline is 28/04.
Other than the auto-notification I've had no acknowledgement, and it hasn't appeared on MCOL.  I'm most concerned.
I'm almost 80 and required to self-isolate so can't easily post a copy.
    Any advice please?

If you have had auto-notification from CCBC and you have your own evidence in the form of your sent folder, I would just keep checking MCOL daily.  They have been known to get a bit behind sometimes.

    Hi
Quick recap.   I am being pursued by OPS for my car being parked sans permit at my granddaughter's (then) flat premises in Jul 2017.  My principal defence is that her Lease permitted the parking of a car in a designated area, and did not mention the need to apply to and pay a third party for a permit, and this has primacy over any contract between the RTM and the PPC to which she wasn't party.
There are several other arguments for defence if this one isn't accepted, but I am unsure whether to reiterate them (they were in my Defence Statement) for fear of diluting my main point.
    My questions are:
    1. How different please should the Witness Statement be from the Defence Statement?
    2. The latest FAQ from Coupon Mad dated 26/02/20 recommends a template statement against excessive charges.  I am being charged an excessive amount so would like to incorporate some of these in case the judge finds against me, but my primary defence is that there is no credible claim against me at all.  I am quite confused then on how if at all to use Coupon Mad's template.
    Thanks
    V

Have a look at the one I wrote for @Bexon which was about OPS in a residential car park.

Remind me which site this is, and have you got the landowner authority document from a POPLA appeal pack, or have you not yet seen the landowner authority because OPS haven't yet sent you their WS & evidence?

Was this self ticketing, or no ticket placed on the car and some nosey neighbour just uploading some photos in two seconds flat?

What's your hearing date and where (pm me if you prefer).

Did you read the thread about the Lewes judgement or had you missed that fun?
