ParkingEye private ticket but was not parked

Following on from this post I made: (https://forums.moneysavingexpert.com/discussion/comment/76293262#Comment_76293262)
I have received another LBC from ParkingEye who say that my ParkingEye appeal has been rejected and I was given a further 28 days to lodge a further appeal with POPLA. However, I never received a rejection letter nor a POPLA code.
I made my appeal to ParkingEye (via their website) within 28 days of receiving my first letter (although they claimed to have sent me a letter prior to this but I never received this). I then received a LBC but this did not mention a response from my appeal. The LBC triggered me to submit an SAR, after a month later I received an SAR response via email. I've recently (a month after the SAR response) received yet another LBC which states "when ParkingEye rejected your appeal, I was given 28 days to complain to POPLA". However, I never received any notification of the result from my ParkingEye appeal nor did I receive a POPLA code.
This 2nd letter of LBC is the first indication I have been informed that my ParkingEye appeal has been rejected.
I'm not quite sure what the next steps should be as the original guidance thread was confusing in terms of what to expect following the parking company appeal stage.
I'll send an email to the parking company to see if I can get a re-send of the rejection letter and a new POPLA code.
Any further advice on this?

If this is the same issue you should reply on your original thread.0

for context .... posted on POPLA appeals thread.........

1. Have I missed the window to appeal to POPLA? (ParkingEye say I have as it's been more than 30 days)
Yes, and if you got a rejection of the first appeal (email or letter) that will have made the deadline clear.
Quote:
2. Can I still appeal to POPLA?
No - unless P/Eye give you a new POPLA code - and surprisingly, sometimes they WILL at LBC stage f you ask!
Quote:
3. When should I have appealed to POPLA and where is this mentioned in the thread?
When your first appeal was rejected, that letter had a POPLA code on it and told you that you had 28 days to use it. If you got that rejection letter the clock was ticking.

4. When should I be creating a new thread to cover my details?
Now if you wish, but maybe try emailing P/Eye first and asking for a new POPLA code as their rejection letter wasn't received:

I think the issue is that I genuinely didn't receive a rejection letter or email. I wasn't aware how long the appeal was going to take so this LBC letter is the first indication that it was rejected.

Can you clarify what you mean by the vehicle was not parked?
double dip? driver was waiting for someone? what?

What's the issue? I started discussion in the existing POPLA thread but moved discussion into this newly created thread as soon as someone said it was okay to create a new thread. I read all the information given here: https://forums.moneysavingexpert.com/discussion/4816822/newbies-private-parking-ticket-old-or-new-read-these-faqs-first-thankyou
But it said to create a thread only when a small claim was being made. Given I'm at the LBC stage, I didn't think I should be creating a new thread.
Anyway, it's all a little confusing for those coming into it for the first time.0 -

There is an electric vehicle charging point within the car park where the car was charging. The space allocated for this is not a parking space but a charging space. So technically the vehicle was not parked, it was charging.0 -

Nine times out of ten these tickets are scams so consider complaining to your MP.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking CompaniesYou never know how far you can go until you go too far.0 -
Contact the landowner and ask them to intervene and get this cancelled for you. Presumably you'll have some receipt for using the charging point? Send a copy of that to the landowner. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
