Can you request photos from parking company?

    From your post it would seem that your friend has missed the simple appeal to the PPC, the request to the hospital PALS and the POPLA appeal and now it has gone to a court case! Did your fried ignore all letters? Has he received a court claim form from Northampton CCBC. If so, what is the issue date on the form? Has your friend completed the AoS on line? Best to get your friend (or you if you are helping) to read the NEWBIE sticky on page one of the forum and look at post # 2 for some pre-written defences.

    Your friend should submit a SAR to the PPC asking for all data and ALL photos of the car.

    Thanks for your reply. What is AoS please. I'm not sure what action he has taken in detail.

    I'll mention your help when he gets back.
    I don't think he ignored anything.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
    You never know how far you can go until you go too far.

    Thank you for your replies.
    I am trying to read through the Newbie thread.



    He did appeal but was turned down.



    Yes he has had word from the court but no date.


    So is it too late to request a SAR.


    Also is it too late to ask the solicitors, theirs, to suspend while he requests the SAR.


    There is a technicality that would hopefully show in the SAR.



    Could he ring the court to put it off until he does the SAR.


    Should he be specifying his reasons or will that spoil his defence.



    I don't want to put too much information on here.

    Yes it is too late for that now that a County Court Claim has been issued.

    Thank you. I will ask this question of him later. He has an elderly relative at the doctors.
  • On 20 May NCCBC sent him a letter stating they had received and sent his defence to the claimant, the parking company. Advising that the claimant had to contact the court.


    He returned N180 to NCCBC on 8 July.



    As he asked for it to be referred to his local court he received a letter from them on 16 July saying they had the referral.



    On 7 August a letter from local court says if witness statements etc must be received to court by 4 September otherwise the case would be Struck Out.


    The parking company sent their information to court on 12 September.



    Should he contact the court to see if it's Struck Out?
