Their WS, not defence of course. It even telslyou its a WS!
Your job is to go through it, using the no doubt multiple threads as this will NOT be a new WS, but a template thats been ripped apart multiple times before.0 -
Thanks, so I assume its OK for them to be represented by an advocate?Notice is hereby given pursuant to CPR 27.9 (a) & (b) that my client will not be in attendance at the hearing and wish for the Court to decide the claim in their absence. Please note that my client will be represented by an advocate.0

Of course it is - why would you think otherwise? YOU could be represented by one too if you wanted, although it would be a waste of money that you wouldn't be able to recover.0

Not sure why you've posted in this thread, but ... don't you mean transcripts? (You already have the claim numbers). You could try the Parking Prankster blog, or try Googling.0

Hi all, my case is due to be heard this Friday but I've just been contacted by the court who asked if I'd be happy with a Paper Hearing due to one of the judges being in self-isolation.
Can anyone kindly advise me on this please - Would I be better off with a Paper Hearing, or could it be detrimental to my case if I don't get the opportunity to attend/speak?

For a paper hearing you must have complete confidence that your defence, witness statement and evidence will stand up to close scrutiny. You will not have a chance to question anything the claimant has claimed in their submissions. Of course it is the same for the claimant as they won't be there either.2

Thanks for the reassurance - I'll politely decline the Paper Hearing (I'm strangely looking forward to it anyway!)0

The court may decide to adjourn your case to a later date, so be ready for a delay in getting this sorted. Better in my view than an 'on the papers' hearing, where things might go through on a conveyor belt basis. Your best interests might not be well served. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
