County Court Claim Form Received

Issue Date: 06/09/2019
In the County Court Business Centre Northampton
Claimant: Premier Park Ltd (BW Legal are their Legal Representatives)
Particulars of claim: PCN issued for £100 on 02/08/2014 not paid
Amount claimed: £197 (includes £37 interest + £60 in costs)
Court fee: £25.00
Legal Representative costs £50.00
Total amount: £272
Claim: the defendant failed to pay the PCN within 28 days
We paid for parking on the day in question but underestimated the amount of time we needed to complete our coastal walk and we returned back late - I honestly cant remember how late we were but I'm i'm certain it wasn't particularly long (more than 10 mins but less than an hour). We didn't keep any correspondence from either Premier Park Ltd or BW Legal so cant confirm any specifics - the court notice doesn't specify either it just states the PCN wasn't paid.
So far I have:
Completed the AOS to secure more time to prepare my defence
Complained to my MP (sighting a Breach of Parking (Code of Practice) Act 2019)
Sent a SAR to Premier Park Limited (not sure i'll get this back in time to get any photos/details etc. to reference in my defence)
I've read hundreds of posts over the last 4 days but I'm unsure which template to start with - I apologise in advance if posting this new thread was the wrong thing to do!

So, are you saying you were waaaay over the expiry shown on the ticket (do you have the ticket and are you sure you were a long way over?), or are you believing their timing that has added the 'arrival' time into the mix and made it look like a longer 'overstay'?

That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
When you are happy with the content, your Defence could be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

Hugo Swire's (Conservative MP) Office have just called me to confirm they're contacting Premier Parking & BW Legal on my behalf to challenge the PCN I've received. Incredible seeing as I only emailed them a few hours ago.
I took advice from posts suggesting I sighting a Breach of the Parking (Code of Practice) Act 2019) so thanks to whoever posted that!0 -

Thats fantastic wish my MP Sara Wollaston !!!! had been more proactive , even Kevin Foster who raised a debate in Parliament about Private Parking scammers was not forthcoming.0 -

UPDATE:-
Premier Park Ltd have just confirmed, over the phone, that my ticket expired at 15:20 and the Patrol issued the PCN at 16:43 - clearly a lot longer than the 15-20 mins I vaguely remembered
I'm now concerned I may be fighting a lost cause if I go down the 'grace periods and green button' route - but think perhaps I should focus on, the additional £60.00 charge and an Abuse of Process in an attempt to get my case thrown out.
Any advice would be greatly appreciated!0 -
Whatever you decide to 'focus on', keep in mind that......you have until 4pm on Wednesday 9th October 2019 to file your Defence.
