Thanks I've just read a few, interesting reading.
I've also noticed that the amount demanded from the claimant on my copy of the court bundle they sent the other day is higher that the amount in the court paperwork?0 -
Because of the hearing fee.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Was that not the "estimated court fees" they put in previous paperswork?
Tbh there are differing amounts on most of the documents, I'm going to look through everything again today
Yes I've just checked the claim form and the court fee is already added along with "legal representative costs" bringing the total to 229 but the other paperwork says 2560 -
There are 2 court fees - filing and hearing - which probably amount to £70. Perhaps show us a breakdown of what they're claiming?Jenni x2
-
It's the £27 Court hearing fee, (for claims up to £300); used to be £25.2
-
OK so this is the full breakdown of what they demanded since the first pcn of £70
Jumped to £90 on final demand (£20 "debt recovery fee")
Then to £124 although no breakdown given.
1st loc for £201 (2.73 interest, 25,court fee, 50 solicitors fee)
2nd,loc (1 year later) £207, same costs although now £8 added in interest.
3rd loc, (2 years later) £234, with £25 interest, 35 court fee and same solicitor cost although the loc wording has been changed from "principle debt + initial legal fees to." principle debt + debt recovery costs.
Then £229 in a letter last December asking me to settle before court.
Court claim form left column £90, then £20 interest, £54 recovery cost (£164)
Right column £144, plus £35 court fee and £50 legal rep cost (£229)
Final letter last week £256
I think that's all and apologies if it's very long winded as always your help and indeed the help you have already give has been brilliant.

Like we said. Hearing fee. Only comes into play at this stage, as it isn't paid earlier.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

OK thanks, just making some final notes before the morning.
I will let you know how it ends0 -
OK so I lost
And won a bit.
Judge was decent and very helpful. But ultimately he had me on the grace period, he said as it was a free car park then no grace period to come in and read the terms necessarily applied.
He did throw out the £54 costs and threw BWs argument about that clean out the window. Also threw out the extra £20 debt recovery charge off the final demand.
Also he actually laughed at the 8% interest being demanded, reducing it to 1% but only from the date of the claim so 54p
He did say he had absolutely no issue with what BW called an unusable copy and paste defence even going so far as to say it was quite good.
So, a mixed bag but it's over and I'm off to burn every bit of correspondence from them cowboys while having a beer. Does make me smile that after 3 years of chasing they probably spent more than I'm gonna pay them.
Anyway thanks people it's been a ride
Have a good weekend
