DWP's Obligation to Benefit Claimants

James, I was going to comment earlier, but stopped.
I only have one question.
Is this thread on Moneysavingexpert helping you or likely to help you in anyway ?
If the answer is NO, there is little point in you continuing.
If you have a complaint with a Government department, then ask Citizens Advice for help. Or if you Don't need help raise a complaint with DWP and send a copy to your local MP.The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.0 -

Crossed posts. No, I'm not a BUPA patient. I'm on Carer's Allowance and Income Support, so BUPA is way out of my range. I am aware that DLA, at any rate, is not paid for the fun of it - my son has been on high rate care since he was three months old, and high rate mobility since he was three years old, which are the earliest ages possible. He was born with severe and life threatening disabilities, and at 21 years old, still needs full time care.
I still maintain that the DWP are not at fault, and you cannot expect them to pay your benefits again (or even those that you would be entitled to - your DLA would have stopped after 28 days in hospital). It seems a very high amount of benefits if your DLA did stop. You did not know that the thief was emptying your account, so it was a reasonable question to ask regarding informing the DWP about going over £6000.
I still do not see how the TSB allowed a third party to access your account and move money into his own account. That is where my concerns would be, rather than trying to get the DWP to pay you again.
I do think that you have a duty to protect yourself from dishonest people where possible. This includes not giving your card to others. Obviously the thief is in the wrong, but you seem to have made it easier for him. Have you asked the TSB why they allowed unauthorised withdrawal of your funds?0 -

I hope I did not offend to much not the best of times kingfisherblue.
I have not asked why there is another post on the banking board entitled TSB Account Opening on the same subject with more details.
Kind regards

Yep, it was all declared and the DWP were told on the day I was admitted that I was an inpatient so no issues there and been through Debt Management after I was changed over to PIP and they went to pay my Severe Disability Premium again and the Greenock Benefits Centre said debt management want money from that £800 then it turned out to be £68 according to Greenock but when I called Debt Management they said "there is no debt to collect" and there was not none.
It was my Housing Benefit that stopped that made me statutory homeless unintentionally as I remain to this day I never went back to the address the second debit card was sent to at all. Never been near it since.
The hospital experience was hellish.
Hopefully it won't happen again.
Have you read the thread I started "TSB Account Opening" on the budget and banking board.
It is quite s story.
I wish their MSE TSB rep would appear from somewhere and not leave it up to the FOS to sort out. More public money down the drain.
Thanks again.
