    Im sorry but you should have left the banana in the bag untill you had left the store, were the the bananas reduced due to the date or the banana that you says was unfit, youve got yourself to blame there debtdestroyer, just out of interest you dont knw business student as you two have something in common re tescos

    I've got a banana in my car I bought 4 weeks ago. skin's quite black now.
    Probably have that for lunch tomorrow.
    Nowt wrong with it.
    Bananas keep well. Just the skins can go iffy looking.

    I'd tend to agree with both points of view, you could have left the banana in the bag, and the staff treat you like a thief when you just happened to not wish to include a rotten banana in your purchase. Whether they allow you to take a picture or not is neither here nor there in my opinion, did they ask your permission to use however many cctv cameras throughout the store? I doubt it.

    It seems like it shook you up, but a possibly good response would be to seriously p*ss off the security guards by inviting them to call the police again and again since you obviously did something wrong and asking them why they behaved the way they did, and asking for the store manager making a bit of a scene.

    Grabbing your shoulder and going for your phone is technically illegal, but the police are unlikely to act unless they caused damage to the phone or your shoulder. Civil action is also unlikely to do much good. I'd be going to the store manager once you've got over this event and put a straight story (be careful as saying "oriental woman" may put you across as racist, even though you're not being (people get all funny about it these days). Try to use her name if possible, or offer to identify the member of staff if requested.

    Reflecting on this, and knowing this store very well, I do wonder if there is perhaps some exaggeration in the OP's account.

    The OP describes 'a number of other security guards'. I would say that there are probably two security guards in the store at any time. They could have called for assistance from other guards in the shopping centre, but it would take time for these to get to the store, and I cannot imagine that they would do this without genuine concern.

    If I were to pick up a bag that was discounted, I would look for the one with the best number of bananas that looked good in it - and weigh up whether the discount justified however many bananas I'd be binning. I know some people do do things like taking bad things out of one bag and sort of making an ultimate bag of stuff, leaving the bad stuff behind. At least the OP didn't do this which I'd have said would be more questionable. Simply removing a banana you don't want doesn't seem bad in comparison with trying to replace it with a good one.

  • False imprisonment IS a criminal offence - as is the assault and battery the OP was subjected to. The OP should report this to the police - they are duty bound to investigate such complaints. There is likely to be CCTV evidence still available of this incident, which the police can seize.

  • Well thanks very much for the words of support everyone! (remove sarcastic tone for those who were actually supportive)

    Regardless of the banana (which was in a plastic bag sealed with the rest of the bunch - this is why I had to remove it. They were reduced to 20p/kg, so it wouldve made a difference to the cost) the stores reacton was seriously out of hand. Now im less shaken tehres 2 main points ive got to make:

    1. The staff member grabbing me by the shoulder amounts to common assualt (the words of the police officer I just gave a statement to). imagine if I went into tesco and lunged at one of their staff - id be carted off in a police van before you could say Every Little Helps.

    2. There were indeed at least 5 staff members surrounding me outside the store (3 or 4 of which were security guards) and I did indeed feel very intimidated.

    Quite curious to know what part of my account suggests I was 'looking for trouble?' to be honest.

    And with regard to me taking photographs, in the words of the afforementioned police officer - they didnt ask you permission to record you on their cctv did they, so its certainly not illegal to take a photograph. All they can do is ask me to leave, which they did not do.
