    I've just had a quick look around and it seems that it is perfectly legal to take photos in private property that you've been given access to.

    The police do tend to take an interest when it's an airport or train station or public building though ;)

    I feel more sorry for the £5.52 minimum wagers who have to act as Tesco bully boys and stop people like the OP and shoplifters. Most of them are just good kids trying to earn a part-time wage without all this hassle.

    Doesn't matter. I don't agree with the OP and I wouldn't have done it myself, but Tesco were completely in the wrong in their response. They should've asked him to leave. If he didn't then they could force him off the premises. They chose to try and keep him on the premises which kind of negates the possible trespass by the OP. So the only possible illegality is by Tesco, not the OP.

    Thats not so much the point I'm making. I'm more talking about how being spiteful to people will make them react. The op brought this upon him/herself.

    If the op were to treat the staff more like humans rather than trying to be a little Hitler none of this would have happened. It's true, so as far as I'm concerned, it does matter.

    As far as I'm concerned I don't care about the legality of it, it's nice to see a spiteful consumer getting a taste of their own medicine, which although the action were different and questionable it's true.

    People get too wet trying to defend spiteful consumers but as far as I'm concerned they deserve it. As I quiet rightly say, a taste of their own medicine.

    It's a pitty so few of them (and others) have the self awareness to realise it.

    I feel sorry for the unwanted banana.
    Being called 'bad', 'black' and 'offending' not only constitutes racism but is downright rude to a bananas sensibilities. Also the taking of the photograph without the permission of the offended banana amounts to the breach of banana protection laws.

    I think the banana should sue.;)

    Well I disagree, although I do understand what you're saying. It does sound to me as if the OP was provoking a reaction and he got what he wanted and more besides. But it's the over zealous staff that may treat other people in the same way as well. I remember I once went to get some photos of the outside of a shop on a kind of retail park. It was for some paint damage done to my mum's clothes (there were no wet paint signs at the time) and it's what CAB advised to do. I took a couple but it didn't seem to prove anything other than where it happened so I decided to leave and I was surrounded (by the painters in fact) and prevented from leaving and they were shouting insults at me etc. So I can empathise with the OP in how intimidating a situation like that can be and noone should have to go through that.

    The OP shouldn't have provoked the situation with the wording he used and taking the photograph, but I strongly disagree that this was in any way a justification for the actions of the Tesco staff.

    Yeah but you've only heard his side of the story.

    He's probably exaggerated what they did and way understated what he did. I can gaurentee it. You never tell a story to make the other side seem like they were right. It's always twisted and the wording stretched to suit the argument of the author as much as possible.

    There was a recent event in Tescos Larkfield where a doctor claimed he was assaulted by staff who tried to stop him from leaving after he had taken a picture of the queues with his mobile phone. He said that staff and security were heavy handed. But I also think that he was a bit of a tool for being so petty. If it's busy it's busy.

    I agree that we don't know exactly what happened. Personally I wouldn't have taken the banana out of the bag, I'd have not taken the bag or just pay for it as is. I wouldn't have taken a photo for "environmental health" and if my path was blocked I'd have pushed the guy out of the way. If I was going to report it to the police for assault or false imprisonment it would have to be over something more definite, i.e. I'd tried everything I could to physically leave. So there are many points I already differ with the OP over, even from his POV. As far as the staff go, they have no right to physically lay a finger on you unless they see you steal, damage property or assault someone or refuse to leave when asked, no matter what the circumstance.
