Hi there,
Since the POPLA rejection, I did not receive any communication from ParkingEye until today. I was expecting letters from credit recovery team, but I did not. Today I received a "Letter before county court claim". It is asking me to pay the full amount (£85) or they will take to court. I have 30 days. This is the letter I received:

What are option now? - Do I need to respond to it now or just wait for them to send me notice of court claim?
Many thanks

I have been going through the Newbie thread regarding Letter before claims. Looks like ParkingEye is slightly different? So the first thing to do is do SAR and contact their legal team? It says that to contact legal team if I have anything to say to stop the claim. I am not clear on this.. is it any new information or things like that I think the POPLA has not looked at the appeal in detail? Not sure what is meant by "anything to say to stop the claim" Or repeating the same information in the appeal as sign was hidden etc?
Another issue is that I have moved my address in February, I received this letter as I have an active redirection in place. Do I need to let PE know about this address change?

Submit a Data Rectification Notice to the DPO of ParkingEye advising them of your new address for service and requiring them to ERASE your old address. e-mail address is on the privacy page.
ParkingEye are not very forthcoming with their e-mail address but last year I got this one from ICO: -

So the first thing to do is do SAR and contact their legal team?Yes, if you think they may have more information about you and your vehicle that you have not received. It says that to contact legal team if I have anything to say to stop the claim. You can ask for a suspension of action for 30 days (it's highly unlikely to stop the claim - and once issued, you will have to defend it) for you to receive 'debt advice' (use those words' although you deny any debt exists. It will buy you a bit of extra time to work on your draft defence. The NEWBIES FAQ sticky, second post, tells you exactly how to deal with a court claim, from the LBC right up to the court hearing.Another issue is that I have moved my address in February, I received this letter as I have an active redirection in place. Do I need to let PE know about this address change? You must absolutely tell PE of your new address. When you respond to their LBC, tell them your new address and ask them to expunge details of your previous one, with any and all further correspondence addressed to you new address. In addition, you email the same request to PE's Data Protection Officer via the PE website's Privacy page. Mark your email 'Data Rectification Notice'.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi Guys,
Thank you for all comments and help so far. I am thinking of paying the money off as I am quite busy these days as I am a key worker in NHS and it appears to be a lot of work to defend this.
If I am intending to pay, is it just matter of calling them and pay and then the case is closed?
They are asking to pay £85 than the original discounted price. Is it possible to negotiate this if I am willing to pay?
Thanks again for all the help
Cheers0 -
If you pay you could be funding white slavery, people smugglers, and fake covid miracle cures. These people may have links to organised crime according to one MP I heard in a debate in the HoC last year. Do you really want that on your concience? bYou never know how far you can go until you go too far.0

I would appreciate, if you could answer if its just a matter of ringing them and pay to close this? Do I have to fill in the reply form?0
-
yes you can just ring up and pay .... but ... sadly they are not likely to negotiate ..... why would they .... if .... if you really play on the essential worker angle they might .... my guess is not. You might get better action from your MP's help or local / national press.Ralph0
