Its far to emotive. You can lose the whole introduction as it just sounds like a rant. Don't ask any questions in it either. You need to make statements and assert facts.

It has all the points in such as POFA and signage it just sounds a bit ranty that's all.

Thank you. I will redraft and try to remove the emotive language and the questions.

Most of the opening was taken from this winning appeal (post #3523) https://forums.moneysavingexpert.com/discussion/comment/75832200#Comment_75832200

    And everything else from:

Text in red and strikethrough is to go. Text in green added or in place of.

  • Thank you to everyone who contributed and gave advice and links to other support on this thread.

I have this morning received the following response from POPLA:

    Dear ---

Thank you for submitting your parking charge Appeal to POPLA.
An Appeal has been opened with the reference ----.

Premier Park - EW have told us they do not wish to contest the Appeal. This means that your Appeal is successful and you do not need to pay the parking charge.

    Yours sincerely
    POPLA Team

That avoids them being exposed by an adverse POPLA decision. Typical bully, run away if there's any danger of them getting a smack on the snout!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • I’m more frustrated with the way the local council dealt with the issue. I was thinking of contacting them with the outcome, but feel like I’d just be coming across badly.

In what regard? The council deserves everything that comes its way!

  • Well, I suppose it just comes across a bit bitter, "haha, told you so" type thing.

Just unforunate that I can't take it any further. The Ombudsman won't get involved at that level of council and it seems like they can do whatever they like!
  • Hi SotonCar

Congrats on having your appeal granted by POPLA. Or at least, doing enough to scare off PP.

I know someone who is currently facing court action from PP for overstaying at Ropery Road. The circumstances sound very similar. However, I believe they "overstayed" by a total of 31 minutes according to their invoice.

How long was your overstay? I assume less than this and within grace periods.

They too wrote exhaustively to the local council and received absolutely no assistance. They even spoke to someone on the phone about it several times.

The local Council are dismissive and have incredibly slopy shoulders - probably becuase they know that their contract with PP is coming to an end in October.

The PCN I received stated the vehicle overstayed by 21 minutes.

I'm not an expert and was only successful thanks to the guidance on this forum so hopefully there will be someone who can support this.
