How long does that give me to put a defence together from the issue date?
It tells you that on the back of your Claim Form.

Also any tips on putting a solid defence together?
Post #2 of the NEWBIES thread has links to seventeen example Defences.

What is the Issue Date on your County Court Claim Form?

With a Claim Issue Date of 30th October, and having done the Acknowledgment of Service in a timely manner, you have until 4pm on Monday 2nd December 2019 to file your Defence.

That's over three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.

When you are happy with the content, your Defence could be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. No need to do anything on MCOL, but do check it after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are trying to keep you under pressure. Just file it.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
  • Please advise, thank you in advance

You have several un-numbered paragraphs after para 12.2.

You have no para 13 or 14.

Correction - you do have a para 14, it follows para 15.

You have two paragraphs starting "In summary...".

In one para you have: ''The reply, I am going to pull a section from the reply which deeply concerns me…'' and then: ''I feel''.

Not right for a defence, so you need to change that the the third person: ''the Defendant'' not ''I'' or ''me''.

And can I just check, you used the 'not a PCN' example but is that what you had?

A red card (not yellow/black, so change it to red)? One that said THIS IS NOT A PARKING CHARGE NOTICE? If so, you need to read AdamBuzz14's thread and use his wording at WS and evidence stage and I think he posted his actual court transcript after he won.

You also need to read CEC16's thread please, to learn about the CRA 2015 breaches.

And replace your #12 onwards (to the end), with the newly-edited wording this week, in post #14 of beamerguy's abuse of process thread.

Then all the paragraphs need numbering. ALL of them!

    :)

Did you have a fake red card thingy, 'not a parking charge notice'? The DVLA have stopped VCS from doing that now, so that is worth saying.

  • Yes it is that exact one :)
Would you mention this in the defence?
