  • The letter they sent was double headed so the PCN was issued the same time as the NTK they share the same issue date. I hope that answers your question. Or is it that I need to make that clearer in my Defence? Think that's where I am getting a tad confused. Thank you

    Right, so the NTK was not sent prematurely. That is unusual.

    So you should turn the usual argument (this one that KeithP stated, which is the normal thing we tell people to say) on its head:
    The card affixed to the car at the time of the parking incident is a Parking Charge Notice - a Notice to Driver - despite what it may say on the card.

    So, unlike that usual advice, you should be saying that the 'red card' was clearly marked (if it was?) 'THIS IS NOT A PARKING CHARGE NOTICE', thus, there was no windscreen PCN, and under para 9 of the POFA, the Notice to Keeper arrived far too late for liability to pass to the registered keeper.
