  • Phone PayPal and speak directly to somebody. Explain the situation and the fact the buyer paid in installments. You should then 'win' the case due to buyer revoking his rights to buyer protection as he paid in installments.

Surely the most likely real scenario is that the vase has been broken in transit and nobody wishes to take responsibility for the breakage, so this is not really a case of buyer v. seller.

Why are you suggesting that as a scenario, I can't see any indication that this was the case and there would be no benefit to the buyer in any case?

Even if item was broken it would still be between the buyer and seller and seller would lose as sellers remain responsible for items until they are safely received.

Experience of courier companies - it is incredible what they can break and what they can put forward as "proof of delivery". Others can also be very good and reliable.

The buyer is presumably hoping that his/her money will be returned.

So the seller needs "proof" of what really has happened.
We do not know the terms on which the item was despatched but it seems clear that the vase did reach China. In those circumstances the only person who can reliably investigate is the buyer.
The buyers attitude to investigating may well indicate whether the whole thing is a scam, or otherwise.

In the meantime the OP could perhaps discuss the address discrepancy with his local Chinese restaurant.
I, for example, always used a different address for courier delivery because my own address was difficult to find.
  • So Paypal have now ruled in my favour and the cases is now closed....!

I made various points and it seems to have been accepted, I think as soolin said I think by paying in separate transactions the buyer forfeited his protection!

Does anyone know if the buyer can appeal it or is that it? I am still a bit concerned PayPal with reverse their decision!

I don't know the answer to your question - but it is very good news, and I'm sure you'd agree to me saying (assuming it all stays 'settled') that you've learnt one huge life lesson here about not following procedures in a large value overseas transaction. (and I mean that in a genuine way - not a condescending way!)

If item was broken in transit then buyer would have been entitled to their money back

This appears on the face of it to have been a simple case of a fraudulent claim of item not received- I still see nothing at all to indicate that buyer is claiming a broken item.

Good, the different transactions should have made this ineligible for buyer protection- I just wasn't sure what happened where neither buyer nor seller had paypal protection.

I'm glad you got it sorted.

I feared that might happen. Unfortunately that means no more ebay selling until they launch their new payment system in the UK which has been delayed but should start being offered as a trial in 2020.
