Paypal - credit rating and recovery?! Help desperately needed

    Things you should know about PayPal.

    They are an American company, based in Luxembourg, they currently have over 150,000 unanswered complaints against them, there usual complaints response is to close the persons account and ignore them.

    They will hound you for payment if the case is found against you, but they will instruct a debt collection agency to do this for them.

    PayPal have yet to take a single legal action against anyone in the UK, I can’t find a single case on record anywhere, (if anyone knows differently, then by all means correct me) there are however plenty of cases where they have been taken to court.

    Non of this will appear on your credit file, these type of transactions are not recorded.

    The debt collector will be toothless, as they will not own the debt, so cannot take legal action against you, and PayPal, as said previously, don’t have form for legal action either, so, as long as you have removed your payment card, and bank details from your PayPal account, although they may make a lot of noise, very little else may happen to be honest.

  • Ok thanks for your help. I obviously want to avoid court at all costs and I am sure Paypal do as well, but having never been through this situation before, I just wanted to see how I can avoid this all but not sure it will be that easy.

    I guess I will and see how this case pans out with Paypal...?

    Ok thanks, any idea what happens if I refuse to pay Paypal anything? Obviously my intention would be to avoid getting to this stage but would like to know where I stand from a legal point of view as well? Should I sought legal advice if I get bombarded with debt letters etc?

    I would like to avoid any issues with debt collectors/agencies and will argue my point and explain the situation as best I can but if they can’t get to me pay, do they just stop with it all? Or does it go further?

    If you get debt letters you can ask in writing that they stop sending them. Similarly with phone calls and visits. If you ask them to stop and they continue you can report them to Trading Standards. There may be a slightly different rule with letters.


    Debt collectors are useless unless a court order has been issued. i.e all a debt collector can do is pester you. However there are cases of debt purchasers taking out court action. However if you defend a case, should it ever get there, they usually don't respond and let the case slide. If they did respond and put a case forward you do have the right to defend it. It isn't a foregone conclusion that you'd lose.

    I sent the vase via mailboxes who used a full tracking service via UPS, they took photographs of being packed also.


    I paid for a full tracking service, which was signed for by the buyer and I have received a copy of this from UPS. The name that has been signed is the same as the buyer, so I felt very relieved!


    The buyer has now said he has not received the vase. I have since noticed the address on the Paypal invoice is different to the one buyer sent me and I fear I have been part of a scam and Paypal will now rule against me.
    Perhaps it is worth remembering that couriers frequently deliver to the wrong address etc., and that the signature is often meaningless. It would be sensible to email the buyer copies of all the documents which you have so that they can chase the vase from their end. Something going wrong is not automatically a scam.

    What was the basis of finding on behalf of the buyer? the reason is vital to advise about an appeal.

    Actually it is no surprise in this case as seller gave up seller protection. However, PayPal seller protection is very good and many of us have had no issue with following the requirements for full seller protection and winning these claims easily.

    We've completed our review of this case and decided in favour of your buyer.The buyer stated they never received the item and invalid proof of delivery and signature was provided.

    I should my account is currently -£2000..!

    I obviously sent full tracking link via UPS, shipping number and a copy of the signed paperwork! Not sure what else they would like?

    I provided this on all four transactions, yet only one got ruled against me and the other three are being reviewed. Along this I have received two separate emails stating the below...very odd?? It doesn't seem t odd up!
