    £320 is 2 PCNs not three.  Do you know which one he disallowed?  Which court?

    Did he ignore your objection to the late WS?

    Why did he ignore the Government's evidence that debt chasing costs under £8.50?

    The shop entrance, Southend county court (If I heard it right) 

    Did he ignore your objection to the late WS?
    Yes, he said he cannot accept the 2nd WS as it came too late following my objection. 

    Why did he ignore the Government's evidence that debt chasing costs under £8.50?

    I have stressed this during my objection.

    It is odd that he allowed the fake costs despite the Govt outing them as hugely inflated but good that he disallowed the third PCN.

    No idea what the legal costs were for except the claim filing fee, capped legal fees and the hearing fee.

    Not good to read that; I was really hoping this was one of the winners. A lot of effort went into presenting your case only to end up in front of a judge seemingly lacking in ......... I can't put what I wanted to, I'll get thrown off the forum and into jail!

    I don't think it's terrible except the added 'costs' which are clearly unconscionable and OBVIOUSLY not readable on an Airport no-stopping sign.

    This OP:

    - started here in Feb 2022 with bailiffs about to turn up at her door when she was pregnant;

    - she was forced to pay an extortionate 4 figure sum under protest to DCB to avoid CCJs but they still didn't remove them from her record, IIRC

    - she paid just £11 x 2 to stay two writs (maybe it was just one...can't recall)

    - that got her a cheap set aside hearing where VCS had to return all her money.  CCJs gone;

    - then at this hearing she got one PCN out of 3 dismissed, despite fairly damning photos proving stopping in a bus stop and on a red route at an Airport (which no-one must do!).

    I quietly suspected all 3 would not be dismissed.  Fully expected a Judge to take the view that you do not stop in bus stops or on red routes, and that Airports must be kept clear.  I think she's done very well to extract herself from where she was at.

    Hey there, I'm not sure if I can appeal any further. I'm starting to think about the hearing again and the judge asked me if I wanted to accept the claimant's 2nd witness statement which was submitted late. There was an order stating that all documents should be submitted 14 days before the hearing, but as the court didn't receive the first witness statement, therefore the hearing was delayed. Do you think there's any way I can challenge this now? I didn't even think about it at the time.

    No, I don't see any grounds.

    The Judge was trying to deal with the case efficiently, and if you had agreed to allow the later WS the case could have been heard based on that one.  As it turned out. the hearing was delayed a bit to obtain the missing WS.

    This happens a lot in these cases.  The court loses emails. I don't think it would have changed anything.

    What was odd was the Judge letting them have extra money that wasn't on the sign (the false fees that we hope the Govt is likely to ban) and an extra £179-odd but maybe that was £70 claim filing fee, £70 capped legal fees, plus the hearing fee and a little bit of interest, or the rep's travel?

    Hey there! I'm a bit uncertain, but I think the judgment letter might clarify the charges?. I was pretty frustrated that the judge didn't seem to grasp the point in the claimant's WS about they offer the driver to read the signage/contract where they have no stopping point provided. I said that I was unable to read what said on the boards while i am driving etc. :disappointed:

    Following your initial email to me, I immediately begun to make direct representations on your behalf to London Southend Airport and I am pleased to say I have now received a response, which reads as follows: 
     
    “London Southend airport manages its road safety access consistently to protect pedestrians and drivers at all levels of traffic flow.

    (I used southend airport recently and before.  On the recent visit there were 2 vehicles parked in the car and no vehicles or passengers around.  :#)

    With drivers accessing the airport all being keen to facilitate a PUDO off at the closest possible point to the terminal/train station, the airport is duty bound to deploy logical road safety practices to maintain the safe management of passengers and of traffic flow. This includes the planned location of the separate premium and free PUDO areas and approach road management via the introduction of a Red route, aligned with all other UK airports and large gov funded infrastructure such as large NHS hospitals, Schools, and train stations.  

     

    The airport and its purpose-built train station is a privately owned and funded business that operates within its legal rights.

     

    The existing commercial car parking arrangements are well detailed on the airports website, this includes access for persons who hold a Blue disabled parking badge. London Southend Airport Official Parking - London Southend Airport. Blue badge holder access advice can be found on the website also.

     

    The airport chooses to provide an ‘up to 15 minutes free of charge’ in our very conveniently located Long Stay 3 car park,  just a few minutes’ walk from the terminal and train station, this is a customer service leading offer vs all other London and UK airports train stations that are used by air and rail passengers. Such free pick up and drop off access for terminal and train station access is more usually a free bus ride away.”
