Writing a complaint letter to the chief executive seems quite strong as they are likely very busy. I'm thinking that could be a last resort.They'll still be very busy when the last resort arrives, but by then PE will likely have started court action, and once they do, they are very reluctant to shift. It's a much easier prospect now than later.As as an update from last summer.
Interestingly ParkingEye have sent me a LBCCC.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Yes I did right to the hospital CEO and panel.
It was a full complaint listing dozens of concerns in a 20 page document.
They only answered one question. The reply letter was about 5 sentences.
They stated they need to change the paperwork and communication.
Then mentioned PE is their partner, these areas are restricted. Tickets are to be issued here.
Overall was a waste of time.
Whenever I write, no one answers my questions and gives a different opinion. It's doubtful if they even read the full letter.0 -

The generic replies and accusations from these companies leaves an impression they haven't even looked at the evidence.0 -
They did state that the signed agreement I have for a parking permit was stopped in December 2018 when ANPR came into force.
So this has created a number of problems:
- if I signed and paid for an agreement in Feb 2019, for a system that expired in Dec 2018, I can't see how I can be penalised for it. Unless of course they notify me of the changes which they never did.
- the signs in the car park still refer to permit system to display in your front windscreen, which is what I signed into and paid the money for.
- the car park has two sets of terms and conditions on different signs, one from ParkingEye, and one from Lancashire Teaching Hospitals, each with different rules.
- several signs clearly state "staff permit holders only."
- it does raise the suspicion this is done deliberately.
I was wandering if anyone knows the legality of this? Two sets of terms and conditions.
The disturbing facts are:
- my pictures and video show the presence of many additional signs. PE submitted a diagram denying these signs exist! At the very least it's a trap car park designed to ensure a PCN is issued.
- there whole case against me is I allegedly do not have a parking permit. My evidence suggests otherwise.
On top of this they did not answer any of my questions for the paid agreement I have.
They've basically lied continuously. Whats a judge going to think?
So, email:
enforcement@parkingeye.co.uk
and attach:
- a working link to your video
- a copy of your staff permit
- your photos of the various signs they told POPLA didn't exist
Please don't reply here saying you've already done this,...not to the the legal team at P/Eye, you haven't, and unusually, P/Eye CAN be stopped at LBCCC stage.
So throw the evidence at the legal team.
Tell them you will counterclaim for not less than £500 for misuse of your personal data from the DVLA, given the fact that they lied to POPLA about the signs, that their appeals team showed POPLA a false 'white list' pretending that you were not on a staff permit list, and that there are two contracts running on several sets of conflicting signs, and that even when you complained to the NHS trust they sent it to P/Eye to reply to, which is appalling.
Tell them this is a case that they need to review properly, and drop.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I've looked at my LBCC and there si no email address to contact the enforcement team. Instead it has a postal address in Blyth.
Where did this email address enforcement come from?
Are they not the same same people? I've been told to respond to the postal address.0 -
Coupon mad has a decade in this game and has ascertained all kinds of nuggets over that time , including the PE enforcement email , plus Parking Eye are in Chorley I believe , although the geographical area is unimportant

As an update with my LBCCC.
I did both. Paperwork to the Blyth office and I emailed the enforcement team.
Blyth emailed saying I must pay or court action will begin - it seemed like a copy and paste generic message.
The enforcement team replied saying case on hold - that's nice of them isn't it.

Push them and tell them that you have received a misleading letter but the Enforcement Team need to respond to the allegations or you will be exposing all this in court.
I am amazed you asked how I knew the enforcement email addy! I've done this for ever (over a decade) and had more P/Eye PCNs cancelled than anyone I know.
I have emails for P/Eye and UKPC that I post here often. Amazed you went looking for it in the LBC, of course they don't give that email out to everyone...BUT IT WORKS.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
