    So many questions . . .

And so few answers being given.

Card details do not give access to a bank account so:

They must also have had the login details and password.

Was any order made for repayment?

Assuming you're aware who stole it and they're serving a sentence why do you expect anyone other than them to reimburse you ? As part of sentencing what was agreed ?

Again - what was agreed at sentencing ?

You stated that there are laws that state the bank must repay you so:
And what did your bank reply when you told them this?

It was pointed out that the code covering the banks obligations came into force on the 28th May so:
What date did the transaction take place?

If you don't give answers to relevant questions, why ask for help or advice?

Please be more considerate? Of what?

Also I didn’t want to go overboard with information which isn’t necessary.

Apparently in a few cases when people have gone public with fraud cases they have managed to recover the money from the bank. There is laws in place where if you are a victim of fraud the bank must refund you the money!

Since you are not willing to give information or names then how will you make it public?

You could do that here. Many people use this forum and a Google search brings up threads on here so naming and shaming on here would be making it public.

Or do you want payment from a newspaper for your story?

I found out who it was as my card was used on a website, there after it was transferred into their own bank account.

It’s been proven in court that it was fraud by misrepresentation. The bank sent me a letter stating it is not up for them to decide if it was first party fraud or not. Therefore after he pleaded guilty for a lesser sentence. I asked the bank again if they would reconsider and they won’t. Also the company which was spent on did not use a verified by visa, they just needed to steal my card details.

I have no idea how my account details were stolen. First party fraud is where the bank believes that I am making a false claim, which proven in a court I haven’t. They also decided when they closed my refund claim that I was not “grossly negligent”

There was some interest published in the city newspaper of the individual, I was considering contacting other media outlets to put pressure on the bank and company to reconsider.

This has had a huge impact on my life and studies. Please be more considerate when replying.

Why should my bank reimburse you because of your lack of security? Although as you suggest that you knew the thief, how did they manage to riffle your purse without your knowledge? If this was a lodger, then I could understand, but I do not leave my cards lying around for all to see.

I suspect this was an ex GF/BF who we fell out with?

How? How could they make a purchase and THEN transfer the money into their own account?

Every post is more confusing than the previous one and what you are saying just doesn't add up.

I think you should give up posting on here and seek legal help.
At least if you are paying for advice you might be willing to give a straight answer to their questions.

We need more than that - they paid paypal and then made a withdrawal ? Bought some currency then sold it ?

All you know so far is it's unlikely your bank is liable and that any liability is likely to be with your 'friend'
  • Another question that you have failed to answer: when the person who committed the fraud was sentenced, didn't the court make a compensation order?

(Must admit I don't know the procedure involved - would the OP have had to make an application to the court for compensation? If "Yes", why didn't they?)
