Unable to recover fraud money. HSBC

Hi all

I don't wish to provide too much information on this case however I will outline the brief details.

my student finance was stolen out of my account.
The bank believe it to be first party fraud.
I was aware of who stole the money from me.
They are now serving a sentence for the fraud.
The company that was used for the fraud won't refund me the money.
It's been over a year waiting for the financial ombudsman to even look at my case.
HSBC won't comment on the case.

How can I make the public aware of what's going on? what media outlets can I contact??

Assuming you're aware who stole it and they're serving a sentence why do you expect anyone other than them to reimburse you ? As part of sentencing what was agreed ?

But really you should contact a soliciter as opposed to a forum for advice .

Given there has been a trial it's all in the public domain anyway. Going all coy about the details makes no sense.

Your case is against the person who stole the money from you. Not HSBC.

They gained access by stealing my card details, I found out who it was as they transferred money into their own account

Also I didn’t want to go overboard with information which isn’t necessary.

Apparently in a few cases when people have gone public with fraud cases they have managed to recover the money from the bank. There is laws in place where if you are a victim of fraud the bank must refund you the money!

So why are HSBC liable and why is it fraud rather than theft ? Again - what was agreed at sentencing ?

Wouldn't they have needed more than just your card details?
To make a bank transfer from your account into theirs, they must have been able to access your online account, something that they would have needed log in details for.


I know that it's also possible to make an in branch transfer but they would have needed the physical card and/or proof of identity and not just the card details.
