Unable to recover fraud money. HSBC

    Apparently in a few cases when people have gone public with fraud cases they have managed to recover the money from the bank. There is laws in place where if you are a victim of fraud the bank must refund you the money!

    I don't think that there is a law covering this, only a voluntary code which started on the 28th of May this year.
    What date did the transaction take place?


    Also, if it was after this date, the banks won't refund the money if the person who was defrauded was grossly negligent, something that might be the case if the fraudster got hold of banking login details fairly easily.

    If HSBC have treated it as first party fraud then they're not going to refund you, you should take it up with the person who stole the money.

    It’s been proven in court that it was fraud by misrepresentation. The bank sent me a letter stating it is not up for them to decide if it was first party fraud or not. Therefore after he pleaded guilty for a lesser sentence. I asked the bank again if they would reconsider and they won’t. Also the company which was spent on did not use a verified by visa, they just needed to steal my card details.

    I have no idea how my account details were stolen. First party fraud is where the bank believes that I am making a false claim, which proven in a court I haven’t. They also decided when they closed my refund claim that I was not “grossly negligent”

    There was some interest published in the city newspaper of the individual, I was considering contacting other media outlets to put pressure on the bank and company to reconsider.

    This has had a huge impact on my life and studies. Please be more considerate when replying.

    Who's been inconsiderate? You've just had replies not telling you what you want to hear.

    To answer your question, you can contact whichever media organisations you like. I'm not sure what other advice you expect to get.

    You’ve not explained why you believe that HSBC are liable or what they have done wrong, could you explain what is that you think they should have done to stop the theft?

    As above, there’s no law that would compel them to pay for the crimes of someone else, so if you want to convince them that they’ve erred why not try out the explanation here first, and get some useful feedback?

    Your story keeps changing and you are drip feeding information so there's no point in asking for advice unless you give all the relevant info.
    You clearly stated that the money was transferred out of your bank account into another account:

    How did you find that out?
    It must be someone you know?

    How did they get your login details?

    Did the sentence of 6 months (or whatever) also include an order to repay you at £25 a month for 10 years (or whatever) ?
