UKCPM Gladstones Hospital PCN Court Claim

Hi everyone

I've received a Court Claim from Gladstones and am in the process of filing my defence.
I need help with what specific points to add pertaining to our case please if someone could let us know.

At the beginning of the year, me and my partner were at a hospital in london for his appointment, he'd had a transplant a month ago and we were attending a follow-up appointment. We were late due to traffic and when we got there we basically parked up, displayed his blue badge and hurried to his appt.

unbeknown to us, new parking signage had been put up at the road we were parked at (and had always done for the past few years while my partner attended regular appts.) we parked on the double yellow lines and displayed his disabled badge as normal.

A few days later we received a PCN in the post - I contacted PALS and they forwarded me to the land owners and inspite of me emailing them and explaining our situation they said they couldn't do anything about it as the parking company is dealing with it.
So now Gladstones are taking us to Court.

could you tell me how to attach a pic of the sign here please? - it's one i haven't seen the likes of before and i think it could definitely help our defence

thank you so much everybody

    From the Plain Language Commission:

"The BPA has surely become one of the most socially dangerous organisations in the UK"

    Please read these

    https://www.gov.uk/government/publications/nhs-patient-visitor-and-staff-car-parking-principles/nhs-patient-visitor-and-staff-car-parking-principles

    https://www.gov.uk/government/publications/reasonable-adjustments-a-legal-duty/reasonable-adjustments-a-legal-duty

Has the PPC complied with them?

No-one with a BB should ever be taken to court by a scammer, complain to your MP as nine times out of ten these tickets are scams,

Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. .
You never know how far you can go until you go too far.

Use a free imaging site, they give you a URL which you post as hxxps://etc and someone will correct it for you to https://etc

What is the Issue Date on your Claim Form?

Did the Claim Form come from the County Court Business Centre in Northampton, or from somewhere else?

PALS forwarded my request to the security and parking team. Since the parking company had first sent the PCN a few months ago , the security and parking management team would not deal with it.

The issue date is 17th of July. Yes it has come from Northampton and I have already sent the AOS online.

With a Claim Issue Date of 17th July, and having done the Acknowledgement of Service in a timely manner, you have until 4pm on Monday 19th August 2019 to file your Defence.

That's four weeks away. Loads of time to produce a perfect Defence, but please don't leave it to the last minute.

When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

So was this roadway within the Hospital grounds?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The roadway is outside the hospital but is not owned by them - it’s owned by a certain college that the hospital is near
