This statement just popped into my head last night on the train home from London..if the bank asked for the money back and it was NOT a paypal dispute, could it have been an echeque that failed to clear?

Netty, what did the original paypal notification say? If paypal had reversed the payment there would have been a dispute and you would be able to see the details when you log in.

    Hi Soolin

I have got nothing in my disputes at all. Just a minus figure in my payment activity details of £57.00. It wasn't an echeque, it was instant. I have since received an e-mail from paypal, they have informed me that the bank rejected the payment due to insufficient funds in the buyers account. How they can blame the seller for that and not the buyer I have no idea. So I can go overdrawn in my bank, buy off e-bay and then the seller has to pay paypal back?? I have sent a lengthy e-mail back to Paypal asking a lot of questions and am now awaiting a reply!
    Many thanks

  • I think this should be a dispute between Paypal and the buyer, you have honoured your part of the agreeement.

I'm sure someone will be along to point to the part in the Paypal T&Cs which show that you should be aware of the buyer bank ballance before completing the transaction,:D:D:D

E-bay have just got back to me and they advised me to contact police - as if they are going to be bothered!!

In fact I think the police are all busy looking for 2 lost discs with 25 million bank details on arn't they:D

Unfortunately in Paypals view, I have not honoured my part in the agreement as I did not post using an online tracking service. The printed post office receipt with all the proof they need is not enough!
Yes, I am bitter but I am actually more concerned for other sellers that this could happen to aswell.

  • If the payment bounced then it's a completely different story... how can an instant payment bounce?
    My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

From what I can gather, paypal pay me and re-charge the buyers bank, the bank rejected the charge from paypal so paypal took the money back off me. Bear in mind this also took 10 days from payment to deduction! In paypals e-mail to me they stated 'if you haven't sent the item please don't!! If I waited 10 days to post anything after a paypal payment I wouldn't be able to sell on e-bay as my feedback would be bad.

Paypal contacted me for info. and I sent it to them and requested a read receipt. Within minutes of them receiving the info. they e-mailed me to say that I had lost my case as I hadn't posted the item using a tracking service. They are supposed to investigate but that was a quick investigation if you ask me - the seller has posted using standard Royal Mail so tough - there you go buyer your money back - sorry but it stinks!!

Surely you have a good case to take paypal to court for negligence?

MMM but probably cost me more than the £57 I have lost and then they will revert to their T&C that I didn't send it using a tracking service such as Special delivery or courier and would probably get out of it.
    Thanks anyway.

It still sounds like an echeque..the ones I had last week came through as 'instant payments' but when you actually expanded the email only then did it carry the word pending. In fact for about 3 days week before last all my paypal emails changed their format and looked odd. I spent many a happy hour waiting for paypal to load so I could check each and every one of them..oh and those I sent to paypal in devilment *were* confirmed as fakes despite clearly showing as a pending payment in my account.
