Paypal Transaction Reverse - Please Help!!

    I'm sorry but I just can't get my head around this. So someone with a confirmed address can go on e-bay, buy and item from an unsuspecting seller for say £50-£100 and if the seller is offering standard delivery and the chance to pay via paypal, opt for std. delivery, pay via paypal, then when they get the item tell the bank to get the money back. Paypal then take the money back off the seller and give it to the buyer. The buyer can then say, yes I got the item but as you posted it standard delivery - tough it's now mine for free.

    Yes, I should have found the time to sit down and read all the T and C's - (I did briefly in between running around after my family, but failed to notice that it shouldn't just be a confirmed address but you need to send it tracked.) but there are other non-suspecting people selling on e-bay items with the option of paypal and standard delivery and are probably unaware that this could happen to them. I honestly thought that as long as you had proof that you posted the item from the post office you were ok.

    The receipt shows the date, time, weight, amount, address - everything!!

    I would have been ok if they had told me it was because they hadn't received the item and it was lost but nothing - just the bank wanted the money back!!

    As far as I was aware before, once paypal gave you the money that was it, it was yours and they would have to file a dispute if there were any problems but this buyer hasn't even filed a dispute with me to say they haven't got the item.

    I think this is a serious loophole and more sellers need to be aware of this.
    Sorry but I am still really angry.

    You need to refund asap. And make sure you put in the dispute that you are unable to send to an unconfirmed address.

    Thanks for that, I have since been in contact with the buyer via e-mail and they are ok - they can see I am genuine from my feedback. They are going to get the address confirmed and if they have any problems they will let me know and I will refund and they will send me a cheque or postal order.

    Yes, sellers DO need to be aware of this, preferably before something like this happens. I can't stress enough that sellers need to read the T&Cs, as you have, and see what their obligations are. It's not a loophole - it's a requirement.

    Here's the thing that much of this hinges on:

    Proof of postage is not proof of receipt
    Proof of postage is not proof of receipt
    Proof of postage is not proof of receipt

    That's really all it boils down to - can you prove the item arrived?

    Soolin had a good old rant about this a couple of days ago. All we can do here is advise people when things go pear-shaped - it's not anyone's job to force people to read the rules they signed up to.

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    Hi thanks, I know, I am just really gutted. My point is that if the buyer had told me they hadn't received the item then I would have been more understanding but no dispute or anything so for all I know they could have received the item but just told the bank to cancel the payment!!

    This is what I was thinking..

    I don't think theres alot you can do, apart from to try to make a claim with Royal Mail.

    You'll feel better about it if you work on the assumption that it really is lost in the post. Put in the claim to the RM, see how it goes.

    Don't eat yourself up thinking about how you've been ripped off, it won't help you at all and will just make you bitter.

    Hi again

    I have just been to the post office to post some items - by recorded delivery!!! I mentioned the issue to the post office lady and she told me that if I file a claim with the post office then a declaration will be sent out to the buyer, who then has to sign to say they did not receive the item.

    I have not been informed by paypal the reason why my payment was taken back other than the bank requested it so I have no notification that it was not delivered, no response from the buyer and no response from paypal as to why they wanted the money back!

    So just because it's in Paypals T&Cs it's fine

    Take the following:

    You sell an item for £10, it's not worth sending special so you stick it in the post. Buyer pays via Paypal receives the goods leave you positive feedback and then starts an item not received dispute.

    It can't be valid for Paypal to return the money to the buyer to do so is assisting in fraud and it is a loophole.

    By the looks of it you don't even have to open a dispute, this buyer hasn't - just tell your bank you don't want to pay paypal!!

    Maybe the reason is the bank rejected as there were insufficient funds - but then that is not my fault as paypal informed me that I had been paid. It took 10 days for them to take the money off me - I cannot wait that long before posting an item out just incase the bank wants the money back because there are insufficient funds.

    I am sorry I keep on about it but it has got to me more out of principle than anything.

    I know I probably now do not have a leg to stand on but it is just so unfair. Is there anyone out there that has had this happen to them??? As I said before £57.00 is a lot of money to me at the moment and it is my 3 children that will suffer out of this as it means less xmas pressies which makes me even more cross.

    This statement just popped into my head last night on the train home from London..if the bank asked for the money back and it was NOT a paypal dispute, could it have been an echeque that failed to clear?

    Netty, what did the original paypal notification say? If paypal had reversed the payment there would have been a dispute and you would be able to see the details when you log in.
