My original email was addressed for the attention of Mr Gallaghar, but unfortunately this other person replied.
I noticed at the bottom of the email I was sent it states “As we have reached the end of our process, it will not be appropriate to respond to any further correspondence on this matter. For clarity, if you choose to send us further correspondence, it will be noted but we will not respond.”0 -

Send it anyway. It may be the wake-up call they need so this nonsense stops.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I assume I am weeing windward but as POPLA is administered by The Ombudsman Service Limited is it not possible to complain directly to that service? - although I do not know which "Sector" it comes under.
When on the "How to complain to us" page (Ombudsman Service) it talks about "your provider". So presumably it is a meaningless statement when "POPLA is administered by The Ombudsman Service Limited" is stated as far as complaining about POPLA.
Although on the "How we're regulated." page it says:-
"ADR officials
We have one ADR official, our Chief Ombudsman and Chief Executive, Matthew Vickers. He was appointed by the Board on a permanent basis after a rigorous process overseen by the Nominations Committee."
Would it hurt to write direct to Mr Vickers as the ADR official setting out how POPLA have unlawfully decided to reject a valid appeal and offers no further means of resolution.

Right okay so I need to draft a complaint to John Gallagher and then also to Matthew Hickers regarding POPLA ! should I explain the whole situation to Matthew? Or just regarding the appeal?0

You need a brief mention of the circumstances leading to the appeal, then the mishandling of your appeal and the mishandling of your complaint in more detail, but try to keep it concise.
As above, show us your draft before you send it. Put both addressees on the same complaint so Mr G can see you have taken this higher.
You could also mention that your complaint to the lead assessor has been intercepted so it is possible he is not even aware of this mishandling of your case.
Mention all the problems; the miscounting of days, the misinterpretation of sent vs given/received, and the difference between calendar days and working days.
Ask for an assurance that all three assessors will be retrained, and your appeals upheld.
Also point out that you believe this is a common problem as you have seen this happen to other motorists if the comments on the MSE PoPLA Results thread are to believed.I married my cousin. Have you made any progress persuading POPLA of their error?
I have the same issue and have failed to get past their call handler who again asserted that the NtK only has to be sent within the 14 day period.
I think it would help a lot of current and future Keepers if we could crack this injustice0 -
Can you all get together and write as one to the Ombudsman Service attaching a copy of Schedule 4 with the 14 day period definition highlighted?
