  • Exactly SB - that's just how it was. Been down there again to see if we could find anyone in taxi office to speak to but all locked up and the little building just beside weigh bridge is also shut up - cars are parked there all the time over the cobbled area so it clearly isn't governed by Excel or VCS as surely they would be ticketing all of them now - so can only assume it was NEVER governed by them either.

Thanks to Uko post 120 - sorry I probably didn't phrase it right -what i meant to say
So here's the thing - No notice to keeper was received by ourselves ever. They have omitted the fact that they sent 6 threatening letters all demanding money - copies of all here safely in folder - but no mention of them or photos of them and the parking officer(!) statement which states it can be used in evidence in Court has a different date on it to the date of the alleged offence. I'm also intrigued by the fact that they must be using an 'american' camera or technology as the dates are transposed......
what i should have said was they did include the PO's statement but it is dated the day before - so not sure how he could have signed it off as all facts correct the day before the transgression occurred . Possibly he has sixth sense and KNEW it was going to happen before it did, ha ha.
5 letters came from debt agencies but the latest of them came from BW in same envelope as letter from VCS saying they were passing it on - but that letter from VCS was not included in documentation.
can anybody tell me why they take photos of all the windows and inside the car please - of what significance is that?

Only they will know precisely why. Maybe to prove that nowhere in the car was there a ticket/permit, e.g. one that might have slipped off the dashboard, but you can bet a pound to a penny that had there been one visible (say) in the footwell, that photo would be deleted!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Oh I see - playing devious games - although car wasn't parked within car park I asked for a copy of the PDT log for devilment of it, just to see how far they would actually respond - I knew a ticket wasn't required where car was because it was on the road - the response back was:
We note your request for a full list of the PDT log for that day. We are unable to provide this information as the area you parked in is not a pay and display car park and therefore a PDT log does not exist.
    - probably say the same to everyone whether ticket required or not.
Also checked on money claim on line - they haven't update the fact that we emailed DQ to them yesterday, still showing as:
Your defence was received on 24/07/2019
DQ sent to you on 24/07/2019
DQ filed by claimant on 07/08/2019

we have though got automated email response back yesterday confirming receipt of it - just concerned as it needed to be back by 12th August if they don't update their records accordingly. I also posted a copy to VCS - 1st class postage and got proof of postage receipt.

Excel should have marked out a demarcation line where their car park finished. I would have thought that the no parking signs related to the parts of the car park where the other leaseholders rent units such as the taxi business and microbrewery.

I will take a look at their plan that they sent me in their WS.

  • Copy of the plan would be helpful if you could manage to find it.
  • also anyone got any further advice on this:

Yesterday was a Saturday. The Courts don't work at weekends.

That aside, there is often a delay in processing at the CCBC. Keep checking, but look after the automatic receipt email you will have received.

Do not worry. You have a dated receipt.
  • Thanks Keith, I had cut and pasted my earlier post - I had actually emailed it to them on Thursday, 8th to ensure it was there on time - as you say I have the email response confirming receipt - just a little surprised it hadn't been updated. I will keep checking.
