VCS Small Claims Court - Parking in a 'restricted' area

    They've done (or haven't done) plenty of things that should make it easy for the judge to chuck it out.


    I need to look into whether or not they're breaching GDPR but I was struggling to get very far with this.


    When I applied for my SAR from VCS, I got a response from Excel with all my data in it. Their privacy policy says they share data with the 'excel group of companies' but don't define what that means. I emailed them and asked and surprise surprise, got no response.




    VCS and Excel have the same address and registered office and have the same fax number too.

    Hello Keep Calm.

    I understand where you were parked and as I am sure you are aware the Bath Store is no longer there. It will be interesting to see their Landowner authority.

    Using the slider on Google maps there are two signs in October 2014. One attached to the front of the building and one attached to the wall on the left hand side. They are not very noticeable and you would not see them at night. There is no sign at the front of the car park where you would enter the car park . In May 2016 there is a sign at the front of the building as well as the other two signs.

    If you were there at night you are unlikely to have seen the signs on the walls and if there in the day how do they know that you were not visiting the Bath Store?

    It will be interesting to see their witness statement. I think you will be OK with this.

    Excel produce a consolidated balance sheet and on page 18 of the latest set of accounts there are details of all the subsidiaries.

    A little update for you:


    I received VCS' witness statement today. It's the same copy and paste rubbish as normal (even changes my gender a few times and they can't spell claimant). It does not address the points the judge told them to answer in his directions to them, in any way shape or form.


    I've just checked the judge's letter and it states underneath the list of directions that: "In default by the claimant, the claim shall be struck out without further order and the claimant shall pay the defendant's costs of this claim, including those reserved on 22nd October 2019, to be assessed if not agreed"


    1-0 to me.


    I then had a closer look at the stuff VCS had supplied. They've sent me the land registry map of the area they manage, and photos of my
    car parked up. The car is not parked in their area! I can easily demonstrate this using google maps as the road markings show exactly where my car must have been. Which wasn't in VCS's crummy car park.


    2-0 to me!


    I am now thoroughly looking forward to my day in court (16th Jan).

    Keep Calm, as you are probably aware they folded before Upstanding's hearing. This car park is proving quite costly for VCS and Excel.

    Since my incident I have only been back there once and then used the other car park even though one pound more. Just can't give this company any more of my money.

    In their WS how did they deal with the question of landowner authority? They only lease the Excel Car Park anything else is just managed so they should have a separate landowner authority.

    I am no expert but it does sound like unreasonable behaviour. Chasing you through the courts and not being able to back up the evidence. I think that they might discontinue.

    I wonder if your judge has allocated two hours for your next hearing. That's another £250 plus VAT.
