VCS Small Claims Court - Parking in a 'restricted' area

    You could do with the SARS to see exactly where the car was parked. There may be something on MyParkingCharge which will give you an idea. You need the serial number of the parking charge and car registration number.

    I think that you could see them off again.

  • I've got a sneaking suspicion there might not be any photos of this one so I'm keen to get the SAR back. I vaguely remember there was a note stuck on the windscreen but I don't remember any follow up letters. The LBC they sent was non-compliant too and I wrote and complained.


    I will definitely see them off! I've had enough of these scammers now!

    If there was one of those yellow and black notes on the windscreen there is likely to be photo's on myparkingcharge.

    I took a look at some of the area around the Derby Street Car Park and there was a no-parking sign on an industrial unit for a bathroom company. It could be VCS but it is a very small car park. There are no double yellow lines on Miller's Lane in 2016 but there are later.

    The bathroom store has now moved premises to another part of Burton so the landowner contract no longer exists.

    I would take a screenshot from google maps of Millers Lane circa 2016 showing no yellow lines. You may have parked on the road as I think they would have been quicker off the mark if they had a stronger case.

    It may be that all these VCS resurrected claims are a try on otherwise they would have chased these earlier.

    I'm confident I can defend based on the bad signage. The judge really bought into how dysfunctional the car park layout is.


    Do you know if VCS have the lease for that bit of the car park? How did you find out about the leases? If it's held by Excel and not VCS I reckon that might be a nice addition to my case.


    Like you say, they're either going for broke on all their dodgy cases, or I'm now on an Excel / VCS kill list as retribution for winning!


    I'm just glad I've kept all my notes and stuff. Should make the whole fiasco a bit easier to manage.

    I have details of the Excel Lease from the Land Registry. I will look that out as there is another poster who is having a problem with this area. I think that you can also obtain a plan of the area that the lease covers.

    If you are parked on Excel's land and receive a NTK from VCS then that must be invalid. The road (Miller's Lane) is not their land though surely.

    I think that the other poster may have had a wheel on the cobbles. You know what they are like about their cobbles.

    Until the SAR'S are received it's very difficult to form a defence.

    I don't think I'll get the SAR through in time - my defence has to be in on Thursday and I only requested the SAR a couple of weeks ago (yeah that was a mistake...).

    Yes, they are posting at upstanding. Very similar situation to your case.

    It's a game doing a defence without knowing where the car was parked or who was driving.

    My guess is that they are purposely holding up these SAR's to make it more difficult to fight your corner. That could be unreasonable behaviour as is sitting on the claim for four years.

    I can't work out where or how the transgression happened. On google maps between the two images for the bathroom place in 2014 there is no sign and by 2016 there is one but this is if you park on the actual car park and I think you would have seen the sign. They can't stop you from parking on the road before the yellow lines were introduced.

    I do have the details from the Land Registry of the leaseholder but not a plan.

  • Hello,

    Just received my SAR from VCS, a mere 29 days and 12 hours after I requested it.

    It has come from an Excel email address and the email signatory is the excel debt and litigation manager.

    Is this allowed as Excel and VCS are separate companies?
