  • Could you let us know what costs the judge did allow and his reasons for granting/dismissing them?
  • I was awarded £25, as my return travel for the appearance, as a witness. He said that was my full entitlement. I said that I had incurred other costs, as in my exhibit "schedule of costs incurred". He said they weren't permissible.

    What is this judge on ??..of course it's permissible, judges are doing it all the time
    Some of these judges should be re-trained

    Did you reference the CPR? Max of half days pay, capped at £95 for the whole day so max of £47.5

  • You could of course raise a GDPR claim against the PPC ... as they have lost their claim against you then it is evident that they have processed your data without just cause. :)

    Some can be difficult.  You're best having one after they've been freshly spanked and brandied up! 😊. 

    Good main result, bad luck on the 'loss of earnings' front though.

    Happens to me too, in Sussex, very few Judges allow costs.  They are wrong under the CPR but won't listen. 

    Half a day off work is capped at about £50 anyway so that's the only bone of contention.  Your other costs are not automatic and a Judge is entitled not to find that a C has behaved unreasonably.

    I see no real prospect of success with this idea.

    Bargepole may be right, but imo he tends to take CPRs etc as gospel, and underestimates the power of a determined and well educated person to beat the machine.

    Many years ago HMCR tried to overcharge me for vat on a new vehicle which I imported from Spain.  It took me nine months but I eventually won.  They must have spent £££s trying to fight me.  On another occasion DVLA refused to refund me £14 when I wrote off my car in Spain.  Again I won and again it cost the a lot of money trying to deny my claim.   If you shout loud enough you will be heard 

    My advice is to go for it. 

    You never know how far you can go until you go too far.
