PCN POPLA deadline missed.

Hello, I’m so sorry to create this post. I Have read the newbies thread and other threads with similar cases. The driver appealed the initial pcn with Euro Car Parks and they rejected it. However the registered keeper of the vehicle failed to inform the driver they have rejected it so the driver has missed the deadline to appeal through POPLA. The day the driver parked more than 180 minutes over as they were very sick that day and it was very heavy snow in February so they felt it was not safe to drive with this combination and they believed it was a free car park as it had been in previous years.
The RK has now informed the driver he has received and intimidating court action letter which is believed to be a LBC however it has not sent to the driver yet so can not confirm. I have read that the driver does not need to respond as they have not named the driver. It is hard to understand and we are easily intimidated and the driver is a young student. Please help. Again I’m sorry for a repeated post and bone idle ignorance but I have tried to solve this for them.

as you were not the recipient of any of the paperwork it has nothing to do with you, its all in your dads name so he is in the firing line , not you
because he missed the popla deadline he is in IGNORE mode unless the PPC take him to civil court within 6 years
you have not missed any deadlines because your name wasnt on any paperwork

Unless the keeper is going to name the driver, the driver is not involved and should not admit anything, not even on this forum.
You should edit your post accordingly and only ever refer to The Driver and The Keeper who are two different people.
Unless the keeper wants to drop the driver in the mire, they are the only one who can deal with this and must respond to the LBC, if that is what has been received by them.

Thanks for responding. Yeah I don’t want him to take the fall for it (plus he won’t). He has not named me and he is worried about being taken to court. I’ve read so much into it, that it’s a bullying technique and they rarely take a small fee to court. I’m quite annoyed he missed the POPLA deadline but it’s done now0 -

You could quote the ADR regulations at them, which as far as I know should give you 12 months to challenge thisFrom the Plain Language Commission:

if ECP or their solicitors issue a court claim then he will have no choice in the matter
ECP have 6 years to do this and tens of thousands of these go to court every year

The first thing to do once you are on a grown up pooter is to check and edit out all incriminating comments about whose PCN it was, who appealed, and who parked.
Only ever refer to The Driver and The Keeper.
The ADR regulations referred to by Half-way is, The Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015.
It states that ADR must be made available to the consumer (keeper) for not less than a twelve month. Even if the scammers refuse, it will be an additional point to put to a judge if this got to court.
