PCN POPLA deadline missed.

    the charge for breaking the rules on the site are probably £100 as a default charge (not the daily charge) , the signage will tell you or your dad what the actual charge is, plus it will say so on the pcn as well

    the £100 max charge has been in place for maybe a decade or so, just like trains and buses have these "fines" for bilkers and defaulters that bear no resemblance to the daily payment charge of say £4 or whatever

    the extra £75 to £80 are legal charges for the court case, plus any interest on the alleged debt , making about £175 or £180 the total if its not paid and a court decides

    so just like a speeding fine or not wearing a seatbelt can be much more at mags court than if the fixed penalty was accepted from the police officer who stops you

    allowing it to go to court always costs more money if you lose

    ECP could easily hire a litigation lawyer and start court proceedings against people , or just hand the whole lot over to B W LEGAL or similar

    BRITANNIA didnt bother at one time, but now they let B W LEGAL do all the work and they just pass them the invoices and let B W LEGAL get on with it , with millions of tickets in the pipeline (same with others like ARMTRAC)

    this is a big industry with vast sums involved and more and more companies are passing the details onto people like B W LEGAL and GLADSTONES etc

    dont be fooled by the past , at one time there were very few people being "punctured" by sharp objects, whereas now its an epidemic in towns and cities (think knife crime)

    the past does not dictate the future , especially not since BEAVIS lost , this sc@m will continue for many years

    So i have had a chat with him. He has received a letter from debt recovery plus DRP that states £160 must be paid by 04/07/19 or they will hand it back to ECP advising court action. What do i do from here. Wait and go through court?

    Ignore letters from debt collectors, see NEWBIE sticky post # 4, which tells you all about debt collectors and how much power they have - exactly NONE.

    the advice here is to IGNORE drpl , who can do nothing

    as you correctly say , they state that they will recommend to their client to take it to small claims court

    ECP have 6 years to do so, so your dad could be coming to you in 2024 and saying "do you remember that time I received a pcn and refused to pay it when you were at uni ?"

    "yes dad"

    "well I have now received court papers from ECP via the CCBC so what do I do about it now son ?"

    that is what ignoring may do , or you can pay him £160 to get rid of it for good

    the RK could complain to the M.A. of that retail park and try for a cancellation but I suspect they wont get involved unless the weather was really bad that day or there was some other reason for the overstay that can be justified

    the fact is that the driver overstayed by a long time abd failed to read the signs and failed to stick by what the driver would have read on those signs , because its clear on google streetview that the max stay is 3 hours

    this is what led to the pcn being issued

    ANPR cameras clocked the in and out time and a computer noted the time on site and compared it against the 3 hours maximum stay

    big brother wins again

    FYI , cameras and computers monitor roads , car parks, city centres , motorways , supermarkets , hospitals , doctors surgeries etc , nobody can "get away" with anything nowadays

    It was a February day this year when we has such terrible snow so the driver ran off the car park and was so long due to waiting for a migraine to pass, unknowingly missing the signs. I have written to the local MP and Landowner because this was an honest mistake on the drivers behalf and has now gone up to £160. I will await any response. Again could they try the appeals process if the driver was named .
