great to see that this judge is repeating the same decision process
much better than you travelling round to Poole or IOW or wherever and your mum wont have to go anywhere or do anything at all
I cannot see them appealing it or starting again with lower figures of say £175 like Parking Eye do in their cases
if more judges follow this judgment and strike out, then maybe the sc@mmers will back off , ideally it needs to be every case over £175

Just to let you know that the Claim has been struck out by IW Court as an abuse of process (re Parking Eye v Beavis) knowingly inflated claim for an additional sum which it is not entitled to recover.

They did it again ..... after being told by a judge they practice ABUSE OF PROCESS again.
Doubt Britannia will pay them for ABUSE OF PROCESS. But, Britannia are just as much to blame if they let this legal run riot with their money.
This is going to happen more and more, I wonder how long the courts will accept the BWLegal rubbish

Before District Judge Grand
It is ordered that:-
1. The Claim is struck out as an abuse of process.
Reasons
The Claim contains a substantial charge additional to the parking charge which it is alleged the Defendant contracted to pay. This additional charge is not recoverable under the Protection of Freedoms Act 2012 Schedule 4 nor with reference to the judgement in Parking Eye v Beavis. It is an abuse of process for the Claimant to issue a knowingly inflated claim for an additional sum which it is not entitled to recover.
2. This order has been made by the Court of it's own initiative without a hearing pursuant to Rule 3.3(4) of the Civil Procedure Rules 1997 and a party affected by the order may apply to have it set aside varied or stayed not more than 7 days after the date the order was served upon that party.

What about a complaint to the SRA - a solicitor disrespecting court judgments by continuing to issue claims with over-inflated charges despite knowing that a Judge has already dismissed other cases on the basis of abuse of process.
Do the SRA condone them continuing in this way?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
