    You don't get POPLA for these cases, but emailing them is a good way to string the drivel out past the 6 months deadline before it's statute barred.

    Thanks Wammo. My email stated:
    1) I did not want to pursue an appeals process through ITAL and that based on further reading POPLA is authorised to act as an independent appeals services. Particularly in relation to car parking breaches related to railway byelaws.

    2) As such, I ask to provide why I cannot appeal via POPLA seeing as the Dept of Transport authorised.

    3) if POPLA is acceptable, then to provide the 10 digit code and explain why they have communicated incorrect information.

    Can't believe I've fallen for paying these penalties in the past. This organisation really are confusing. But then it sounds like some people have struggled with POPLA themselves.


    Also, just spoke to POPLA who confirmed that:
    1) They handle railway byelaws however not for all car parking operators! Saba / Indigo Parking being one such.

    Forget PoPLA, just asking daft questions. Also get your MP involved as nine out of ten of tickets are scams

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    3 or 4 questions will get you past the magic 6 months.

    I have however submitted the second appeal via ITAL / asparking.co.uk as I was on the 28th day post the original rejection letter in which to submit the appeal. I suspect this was an error, but

    1) I fear that I'll not have this opportunity to 'officially' appeal again beyond this point ie. the verification / appeals code they provide expires. I acknowledge this is about stringing the process out beyond 6 months but shouldn't I at least attempt an appeal?! :question:
    2) I feel like I have solid grounds on which to appeal. The examples given when appealing states examples such as:
      The transport operator failed to meet the requirements of their scheme, the Penalty Fare Rules or, the regulations.
      Appropriate discretion was not applied by the issuing member of staff, in accordance with the train company's discretion guidelines and penalty fare rules.


    The grounds on which I'm appealing (with said photographic / screenshot evidence) being:
      Parking was paid for (albeit for the wrong car park), and no material loss has been incurred by either the private parking company or the train operating company. Therefore appropriate discretion should have been applied
      The newly opened car park has new signage, but the 'main' car park signage has not been updated to reflect what car park you are entering.
      The mobile payment system is flawed. Car parks are in opposite positions
      And I can't believe I missed this one previously, but the car park mentioned on the penalty charge is named differently to that within the app!

    No doubt the decision will be overruled anyway and they'll still try to force me to pay a penalty fee. In which case, I'll be forwarding my appeal letter and support evidence to the BPA and local MP.

    One thing to note, as I've seen other people say not to appeal via asparking.co.uk as it requires you to name the driver. It doesn't. It asks if you are appealing as the registered keeper of the car or appealing on behalf of the registered keeper. The latter requires you to provide further evidence.

    That's a massive error. Asparking are the one body that can bring prosecutions and you've just handed them all your details.

    Not a wise move. At this juncture I would cease all communication. Don't stir the hornets nest and hope it drags out past 6 months.

    Cease communications with who, I assume you mean both Saba and ASparking?
    I'll obviously wait until a decision is made re the appeal (hopefully it gets over turned).
    Do you think I should contact local MP, BPA, or even the train operator ?

    Cease communications with SABA and Asparking. In fact cease communication with everyone except this forum until the 6 months are up.

    Asparking will not overturn this.
