I'm pretty sure the tree is not diseased and maybe you would just like this moved as it blocks light to some extent

If you ask the council who put the TPO on it to come and give it a clean bill of health then that will solve everything.

The tree stays happily in it's place, no threat to anyone and everyone can get on

I suspect though this tree has somehow come to the forefront now you are buying when it was no concern before

I go nuts when people remove trees for no other reason than someone can't see out the window far enough..

You are wrong on a few points, first we have been complaining for a number of years, it gets us nowhere, as we didn't own the tree we felt that there was little we could do, buying it changed that or so we thought!.

We have ask the council for a saftey report on the tree, they have ignored every email we have sent them on that point, we have asked our councillors to give their opinion about the tree they too ignore our emails. What more can we do?.

We have also made a complaint to our local councillor about their tree surgeon saying as a matter of fact on the TPO that the tree was a "black popular" and then saying in the assessment that he didn't know if it was a "Black Popular" that was misleading to all that read the TPO. We have not even had an acknowledgment to our complaint!. I put down the safety of people before the need to keep a dangerous tree up, no doubt you will be wise after an event then you were before!!!.

You can complain to the Local Government Ombudsman.

However, one reason why a council may refuse to respond to any emails is if they deem the sender to be a "vexatious" complainant. You should have been informed if this was the case though, and normally given a single point of contact you could still communicate with.

If the council's trees officer believes they have a "Black Popular" then they deserve to be sacked.

Is it possible that between saying they "didn't know if it was" a Black Poplar and the TPO being made, that someone was asked to correctly identify the species? It is normally the case that the species of a tree has to be correctly identified when making a TPO.

The council's staff will be just as keen as you are to ensure the safety of people is not jeopardised by the tree. If it genuinely poses a risk then the council will take action. However, their assessment of the genuine level of risk may differ from your own.

Perhaps if you posted some pictures of the tree other people on the forum might be able to comment on the tree's health?

I can't see the problem. You will not be better off if you buy this bungalow than if you rent it from the council. Your wife will not be better off if you buy it than rent it.

You don't want to buy it with the tree there. So don't buy it. The tree has a TPO on it so it is staying. Lots of trees have TPOs on them it isn't unusual.

The most secure tenure of any property is a council secure tenancy. This is much more secure than a bought house. So your wife is much better off and more secure if you don't buy this bungalow.

People who own houses have to sell them to pay for nursing homes if they need them so don't buy this bungalow thinking that you are going to leave someone an inheritance because the chances are you won't leave anything.

"You can complain to the Local Government Ombudsman."

We have done just that, they are investigating, I have to tell you we don't have much faith in anything to do with government/council's. I could say more about that but it's not for this thread.

If you came and seen the tree you would agree with us, I will give you a 100% guarantee on that, that's what makes this so, so strange.

If you have a tree surgeons report that says this tree isn't a rare poplar and you have a TPO on a rare poplar, then this tree can't be subject to a TPO. So that would be our defence if you removed it.

    Only joking!

Cakeguts, you along with Sector1 are making a lot of assumptions that have nothing to do with the thread. I have stated the reason why we are wanting to buy this bungalow, it is not to leave an inheritance, my wife and I think there will be a house price collapse in the next two years, we believe it will be a very substantial collapse, we both think that in buying this bungalow we will lose money even after the discount, we are buying sorley for the security that buying will give my wife, please do not assume things that are not true.

Could you please give links to show where on Parliament TV it is demonstrated there are plans to privatise all council housing? I seem to have missed this initiative.

"we know from watching the Parliament channel that it is know looking like that goverment will sell off all council houses to the private sector in the future"

    Silver car,

The councils tree surgeon has put on the assessment that even if it is not a "Black popular" it still merits a TPO.
