Hi Guys,
So BPA concluded their investigation, the below is a timeline of events occurring:- [FONT="]30 May a vehicle was observed parked in breach of the terms and conditions of parking at McDonald’s Forest Gate[/FONT]
- [FONT="]A charge notice was fixed to the windscreen of the vehicle[/FONT]
- [FONT="]25 June an appeal was received from someone claiming to be the registered keeper and refusing to name the driver (appeal made by RK, but put an address where the vehicle is not registered because RK was staying in Cambridge for work)
[/FONT] - [FONT="]8 July an acknowledgement letter was sent to the appellant[/FONT]
- [FONT="]24 July a response was sent to the appellant advising that we can only consider appeals from either the driver, the registered keeper where we have obtained their details from the DVLA or a third party where the person responsible for the parking contravention provides authority, we then asked them for that that authorisation explaining that in the alternative we would request registered keeper details from the DVLA and send a notice to the keeper[/FONT]
- [FONT="]25 July sent a notice to keeper as we did not receive authorisation from the responsible party (no NtK received)
[/FONT] - [FONT="]29 August sent a reminder as we had not received a reply or an appeal following issuing the notice to keeper[/FONT]
[FONT="]As the details in the appeal did not match the keeper details provided by the DVLA, the operator could not hear the appeal due to GDPR.[/FONT]
