What has happened here is that judge has Recognised the BWL scam and whilst the county court is not a precedent, it can still be referred to in any county court as this was a District Judge
BWLegal must now be very careful as any abuse of process will be reported to the SRA
This applies to Gladstones and the other two dodgy legals who attempt to scam people with fake sums0 -
Just an update ref this thread.
Had a call from BW legal on Friday last week, asking me if id recieved their "offer" to pay £170...and had I given it any further considertation......I was out working at the time of the call, so I had no access to any of the info ref this offer, I said that I had recieved the notice in the post and that I was NOT paying this offer, and Ill see them in court, I have information that I will be taking with me to the hearing and furthermore I reiterated that I was not pleased to hear they keep refering to "my account" I have never opened an account or agreed for any of my information to be held on their database in the form of an account!.. I have an account for my utilitity bills, bank etc etc, certainly not with BW Legal, they just ended the call saying they would pass this on to the case manager dealing with the issue.
TODAY, home from work, and a letter has arrived.

The claim contains a substantial charge additional to the parking charge which it is alleged the defendant contracted to pay, This additional charge is not recoverable under the protection of freedoms act 2012, Schedule 4 not with reference to the judgement in parking eye v Beavis. It is an abuse of process from the claimant to issue a knowingly inflated claim for an additional sum which it is not entitled to recover,
This order has been made by the court of its own initiative without a hearing pursuant to CPR Rule 3.3(4) of the civil procedure rules 1998 any party affected by this order has a right to apply to set it aside vary or stay it by application made not more than 7 days after this order was served upon the party
