Coupon-mad wrote: »It seems so. DJ Grand said something like this, as ParkingMad who was watching the case, made some notes:
''it was placed before a Circuit Judge - His Honour Ian Hughes QC - who is the designated civil judge for this area''.
From what I read, there are seven regions of England and Wales where circuit judges are designated and sit in the Crown and County Courts within their particular region.
As BWLegal and the others like Gladstones have made such a nuisance of themselves throughout England and Wales, maybe there are discussions going on behind closed doors0 -
Trying to understand the advice post. Does this mean that the courts say that they shouldn't be seeking a claim for more than £100?0
-
It means:
(a) the Hampshire, IOW, Dorset & Wiltshire area are likely IMHO, to screen and strike out any parking claims that are over £100 now, as there is no need to reiterate the matter again.
(b) the law is on your side in other court areas. Even if your court do not go as far as summarily striking cases out without a hearing like in the above court circuit, by bringing the same issues to the attention of your Judge as I did at Southampton, you can be sure the £60 cannot be allowed.
Everyone can do the same. The only exception is ParkingEye cases as they have not been adding the fake £60, but they can usually be defended on signage, grace periods, or hidden keypads, etc. (that last one being a beach of paras 14 & 18 of the CRA's grey list, in its own right of course). So P/Eye do not get away scot free from this exposure.
CEL and QDR even add £82, for some reason. Same rules of law apply as for those who add £60.

BWLegal have been told they cannot add the fake £60
They are at liberty to appeal to the highest court in the land but they would fighting the ruling of the Supreme Court and that is the ticket price is all inclusive
They like us, know there are judges around who simply don't understand so they will continue to chance it.
Thanks to Judge Taylor in the Southampton court, the scam was exposed and BWL lost the appeal. If BWL continue to try and scam the motorist further then on each one, a complaint should be sent the SRA until they take action
BWlegal is a firm whose business model is to chase and threaten people on proven debts such as domestic bills, mobile phones, pay day loans etc. They entered the parking scam never actually knowing if the debt is real and dealing with the motorist was bound to fail as they attack anyone who is the motorist , never knowing who are they are. ParkingEye v Boden was a prime example as it cost PE £1500.
The motorist v BWL is now on the winning side as the law protects the motorist .... now proven.
Gladstones are yet to wake up with their lemming style attitude and as time goes by, they in turn will get these spankings plus all the usual spankings they receive
The members of the IPC seem to think that their CoP (IPC) applies to the motorist and the CoP entices these members to add on fake amounts by saying .. "their maybe an opportunity to charge more". The IPC encourage their members to break the law.
All part of the Gladstones/IPC scam
Onwards and upwards to lots more spankings being handed out to all the dodgy legals/PPC's0 -
Not sure if I should start a new thread or this is the right place to ask my question but here goes.
I’m in exactly the same predicament with an order against me from Britannia, due for hearing at Southampton.
Will this now be thrown out or are Britannia going to go through the whole charade again?
Any advice would be more than welcome and if you fancy another trip to Southampton Coupon-mad, I’d be happy to pay your travel.0 -
Yes you should start your own thread, and yes you must raise this in court. You never know how far you can go until you go too far.0
