    Although I'm going to have to likely pay the hearing fee as well.
    Why do you think that? You only pay fees if you lose, so why do you think so?

    well worst case scenario (I'm hoping) is I'll have to pay 30 quid twice which is what the original charge was for the alleged "violation of the contract" :rolleyes:


    on that basis I'd have lost the hearing, they'd make me pay for the cost of it yes?

    Potentially yes.

    Albeit I can never recall a Judge awarding a case against a Defendant and only expecting them to pay £30. It is usually a 3 figure slap of a loss, or far more commonly here, a win.

    I still have no idea of your chances and I repeat this:
    I gather from your thread title, it's about Excel at your place of work, but I don't see your first post on every page as I detest that forum view, so I know nothing else.
    Details please?

    What is your trump card?

    What did you put in as evidence?

    Have you filed & served a copy of Sch2 of the CRA 2015 with the WS?

    Have you included a costs schedule?

    Costs schedule was submitted. Unreasonable behavior is the trump card (they passed my details onto DCBL after the court had given them direction that it was a defended claim) and ridiculous signage on the site.


    I've received a letter from them today stating that they are confident they have a good case against me but will be willing to settle out of court for £85.

    I didn't include the consumer rights act in the WS or evidence.

    Looks very much like they're starting to crumble.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I've submitted a costs schedule of 1005 pounds.


    510 for the costs of the set asides and the rest on the time I've spent writing documents. 30 hours at £19 an hour. The remainder being postage.


    That letter they've sent is also dated before they'd have even received my WS/Evidence.
